From Page One) McSwain is taken into custody, the circuit court of appeals will be asked to issue a habeas corpus writ. j Touhy wants the FBI records for his fight for a habeas corpus writ to release him from prison. He is serving a 99-year sentence at Illinois state penitentiary for the kidnaping of. John (Jake the Barber) Factor in 1933. Touhy says he was “railroaded" and that Factor never really was kidnaped at all. Three people were ready to testify to that effect, affidavits they made in 1938 indicated. Factor allegedly was kidnaped the night of June 30-Julyl, 1933. Twelve days later he was found wandering the streets of La Grange, 111. Reputedly one of the nation’s most expert swindlers, Factor was facing extradition to England on charges that he engineered a big gold mine fraud there.
