"Do's And Don'ts” Os New Rent Agreements Listed By Director
A list ot Do's and Don’ts" for the guidance of landlords and tenants who are cbneldering voluntary lease agreements Increasing rents up to, but not more than, 15 perrent was outlined today by area rent director John K. Williams, who conferred with tenants and landlords at the Decatur post office. The rent director slresed that rents cannot be raised by lease agreements unless all requirements are satisfied. A true, signed copy of leases must be filed with the rent office. Each will be examined carefully. leases which fall short of faceting requirements, or which contain evasive clauses, must be rejected, and any increased rent paid by the tenant must be returned to him. “Do's** Listed 1. Bear In mind that the law says leases are to be signed by landlord and tenant “voluntarily, and in good faith.” No tenant can be evicted for refusing to sign a lease. 2. Put the lease In writing. Rents cannot be raised Sy oral agreement. 8. See that the Increase is no more than 15 percent of the rent in effect at the time of signing, it may Ire less. 4. Be sure that the lease is executed (that is, signed by both landlord and tenant) by December 31, 1947. 5. Remember that at the earliest the lease must not run out before January 1, 1949. 6. Get the registration forms at the rent office. List of “Don'ts” Mr. Wiliams also listed the following “Don't”: 1. Don’t include provisions in the lease which decrease the essential services, furniture, furnishings, and equipment which were Included In the rent In effect at the time the lease was signed. 2. Don’t include provisions which permit the landlord to terminate the lease at his option. The lease must run through the entire year of 1945. 3. Don’t include conditions, provisions. or minor covenants clearly designed to evade the law, such as provisions which permit the landlord to exact penalties or to terminate the lease before the expiration date. “It Is our responsibility under the housing and rent act of 1947." Mr. Williams said, “to check all leases to see that all things necessary to lie done are done, and to make equally sure that no evasive provisions are included, whether deliberately or by mistake.
