TUCKER NAMES LICENSE HEAD GOP Attorney* File Supplement To Appeal From Injunction Indianapolis. May 2 <U.F. Republican elected officials matched an apparently successful Ittva slon of a Democratic controlled state depaitment today with a "last step effort In the alate supreme court to throw off the yoke of an Injunction prohibiting ripper appointments. While secretary of state James Tucker appointed a GOP deputy to "take charge" of the motor vehicle licensing division. Republican attorneys met a high court deadline and filed a supplement to briefs entered in their appeal from the circuit court Injunction. Tucker's appointee was UiWvll M< Dsniel. Hancock county farmer and Indiana director of the corn belt Liberty lx*ague. Governor H< hrlcker apptoved. but the new "b>-ad" obviously was In conflict with his own commissioner of motor vehicles. Edward Stein. Tucker accomplished the appointment by virtue of an old law now operative since ■ epeal of the McNutt reorga nim t lon act. which gives his office authority over the motor vehicle division. Although Stein and McDaniel eapieased the belief they could work in harmony, the former Indicated he wonltj "remain in charge." Nevertheless, McDaniel, with a technical title of deputy s»<,eiary of state in charge of tlio motor vehicle licensing division, was a valid officer as far as the old law la concerned Actually the snecess of Tucker's Invasion was fnektrlcahly linked with the court tent of the rtpper laws, which the brief filed today declared were "in every respect constitutional and valid l» yond per adventure *of doubt ” If the high court were to uphold the validity of the keystone ripper law. Tucker would lose control over the motor vehicle division. The Repnldlcan brief, filed by attorney, Arthur L. Gillium and Fred Gause declared that "each of these statutes In each particular Is entitled to he adjudged constitutional and valid The temporary Injunction against those apoellants l Republican elective officials should b*t ordered dissolved and the Injunction suit in whi< h the same
