TO SEEK TEST OF COORT ACT Seek Court Test On Legality Os Magistrate’s Courts Indianapolis. June 29-<U.R> Ida M Holmes. Beech Grove attorney. Indicated today that he would file a petition for a writ of mandate with the state supreme court to bring about a court teat on legality of the recent legislative act providing for ma Rist rates courts In Indiana. Judge Cox of Indianapolis held the law unconstitutional yesterday and refused to appoint a magistrate for Beech Grove despite the request of suburban residents for the court. Judge Cox attacked the legislative action In establishing the courts and said “It is unnecessary to go so far as to destroy a court system which la serving satisfactorily." He added that he believed the new law took away all Jurisdiction of the local courts which handle traffic and city ordinance ! cases.
