COURT UPHOLDS ’ LIQUOR BOARD Marion County Court Uphold* Ki K ht To Refuse Permits Indianapolis, April M. — (U.R) Right of the elate alcoholic beverages commission to deny beer wholesaler permits on economic grounds was upheld today by the live Marion county superior court Judges, shtlng in general term. The court ruled also that It han the right to hear appeals or rejected wholesaler applkants from rulings ot the commission, as provided In tbe new Markland liquor law passed by the 1»3» legislature. The decision overruled the petition of timer Kllpnch of Petersburg. who asked that the commission's rejection of his application be set aside on the grounds that the commission has no right to deny a permit If the wholesaler applicant meets legal qualifications. The new law declared that the commission could not deny applications on “arbitrary, capricious or political" grounds. Kllpnch asserted that the commission acted arbitrarily and capriciously In refusing him a permit. The ABC acted within Its right under the preamble of the new law, which states the act is “for the protection of tbe economic welfare of tbe state.’' the court held.
