The answer, both from Ribbentrop and the German foreign office,' was said to have been that Germany could give no pledge and that it might be the duty of the German government to intervene in defense of “Germans” in Austria. Ribbentrop was said to have promised to mention the British request for assurances to Hitler on h£9 arrival in Berlin. Nevertheless, while Ger- • man papers admitted their government's complete surprise —and reflected its indignation —at the Austrian plebiscite call, the Itali ian ministry of popular culture officially praised Schuschnigg’s move as logical and said pointedly that it was an Austrian internal affair.

Sponsors of the resolution intended to have the courts rule on the authority. Mooney, who is under a life sentence for the Preparedness day bombing in San Francisco in 1916. was returned last night to San Quentin prison by the warden who brought him before the legislature in response to the speaker s summons. The debate continued in a session of the assembly, which continued until after midnight. The Mooney resolution remained the order of business today. The gallery and corridors were crowded with Mooney's sympathizers and his defenders were frequently cheered. Labor organizations throughout the world regard Mooney as a I martyr to their cause.
