Durbin. 5:1. guilty ot manslaughter after eight hours deliberation. Durbin was charged witn slaying James W. Smith, 22. the night of August 22 during a t altercation at a down-town For' Wayne Tavern. The trial started last Tuesday and the case was sent to the jury late yesterday. Today at 1 A. M. the jury arrived at their verdict and the jury was locked up until the court, presided over by Judge Harry H. Hilgemann. opened this morning. Judgement was deferred until next Monday. The affidavit under which Dur bin was charged with th" slaying of the young Fort Wayne man. set out that Durbin fatally stabbed Smith with a knife. Smith was found critically wounded at the rear of the tavern and died en route to the hospital.
