EXPECT DE VOSS RULING FRIDAY Judge DeVoss To Rule Friday On Mayor Bangs’ Trial Huntington, July 2.—Judge 11. M. DeVoss of Decatur has notified attorneys here that he will be in Tiuntington circuit court Friday morning to announce his decision in the contempt damage case of the Northern Indiana Power com-1 puny against the city of Huntington, Mayor C. W. 11. Bangs and 12 other city officials and individuals. Four days were spent in hearing evidence in the case last month. Judge DeVoss opened the trial June 10 and after three days of testimony recessed until June 17 when evidence taking wap con-i eluded. Arguments were heard * June 22 and at the close of the day the judge said he hoped to announce his decision before the close of the April term of Huntington circuit court July 4. Attorneys for the N. 1. P. in their i pleas to the court asked that all i members of the board of publicworks and S. P. Hull, utility superintendent, be sent to jail until I: private consumers of the munici-, i pal generating plant are discori- I nected, as ordered by Judge David E. Smith, of Fort Wayne, last August in issuing the permanent I injunction. I Members of the board are May- 1 or Bangs, City Attorney Arthur D. | Sayler and City Engineer James I B. Vernon. Vernon in his testi-I mony during the trial said that he understood when he accepted ap-] pointment from Mayor Bangs that 1 he was to have no connection with 1 the unofficial ttility. It has been wondered if the I awaited decision of Judge De Voss; has any connection with the failure to date of the five insurgent] city councilmen to call a third special session. The ordinance fixing rules for removal trials of certain city officials and employes, twice vetoed by the mayor, is now ready for passage again. No call has yet been issued for a third i meeting and some observers pro- i fess to see a connection between the delay and the forthcoming visit of Judge De Voss. o RAINS BRING (CONTINUED FKOM TACIE ONE) , gram.
