RULES AGAINST CITY LICENSES Deputy Attorney General Rules Against Beer Dealers License Indianapolis, Jan. 24— (U.R) — Cities and towns are without power to charge retail beer and wino dealers annual license fees, Herbert J. Patrick, deputy attorney general, ruled in an unofficial opinion late yesterday. In answer to a query from Harryi Long, city attorney of Gary. Patrick said; "It is probable that the city council of the various municipalities have the right to impose reasonable regulations upon these dealers, but it is extremely doubtful whether they are authorized to require a license fee." "As a matter of fact, the state law provides for a division of license fees between the state and municipal corporations, which division itself, would indicate that there should be no further license fees exacted by the municipality." Patrick suggested that the best method of settling the question would be for some city to require a license fee and institute a test case.
