Upstairs, Downstairs Or—Well The Court Must Make Decision Muncie, Ind., Sept. 24—(UP)—.Hairsplitting distinctions of such legal intricacy that counsel have submitted briefs, arose in the ease of Hoy Fullhart, proprietor of Eureka Ityt, charged with violation of the prohibition law. The search warrant in the case gave the address of 212 West Twelfth street. Fullhart’s counsel asserts his client was a tenant of both floors of the building at that address, and that to legally search the second story, the address of 212% West Twelfth street should also have been specified in the warrant. Officers testifying to find liquor said it was ‘"in an under" a stairway. They asserted the liquor was on top of a closet beneath the stairs. i The question before Judge Clarence W. Dearth of tlie Delaware circuit court is whether the liquor was found upstairs or downstairs. If upstairs, the warrant is faulty, attorneys contend, because it did not give a "good and sufficient" address. ———<> — Past Commanders Os Legion Touring Europe Paris, Sept. 24.—(INS)—One Bf the most Important events on the program of the American Legion's pilgrimage to Paris got way today when 250 past commanders of the legion left Paris in two speclol trains for a two-wceks’ tour of Europe.
