Wheat started downward on a wave of selling based on lower cables and favorable weather over the krowing belt. Bromhall reported the break in Liverpool due to heavy liquidation of American receipts and favorable rains in the three Canadian prairie provinces. Corn stubbornly resisted the general market tendency. Acute moisture shortage in principal producing sections helped to hold off bears. Oats followed corn and were com paratively steady. Provisions opened firm with hogs. Stewart s move was totally unexpected. Scott had abandoned all hope and penned what he regarded as his final message to the world. It | was 11 p. m.. some four hours after Governor Len Small had denied the
appeal for another reprieve, and seven hours before the time set for execution. when Stewart injected himself into the case. Mapping out the final piece of strategy, Stewart started a mad hunt for a judge. It was not until 1 a. m, after numerous telephone calls, that .Stewart located Judge David at a loop club. I "For God’s sake, convene court right away.” Stewart and Thomas Scott, father of Russell, pleaded. 1 Judge David demurred. "Please give us another chance,” Thomas Scott, aged, eary from his long fight, broken by grief, begged. ‘‘Heat what we have to say, please.” Judge David filially agreed and ordered his clerk and bailiff summoned. The little party made its way I to the court, treading the darkened streets to the eburt. The news of a move had flashed around the loop and a little group of stragglers joined the procession. At 2 o’clock the two court attaches arrived, and court was convened. The rattle of milk wagons and the whirr of automobile engines floated Into the courtroom. Newspaper photographers appeared, but the judge warned against taking any flashlight pictures. One photographer disregarded the warning and a boom and burst of flame startled the gathering. His face dark with anger, Judge David imposed a fine of $25 on the photographer for contempt of court. After a few preliminaries, Stewart said: 1 “Your honor we have here a peti- , tion sworn to by Thomas Scott, fath|er of the condemned man. The petition sets up that sifvee sentence was passed, Russell Scott has become insane. and we ask your honor to stay thin execution, set for sunrise, until I the question of his sanity may be determined.” ' Stewart further set forth that Scott
I was insane to the exten that “he is I now unable to comprehend his present predicament." “Scott's sudden cessation of a drug taking also contributed to hia condition." Stewart said. Judge David asked whether the state had been notified. Stewart said ho had been itnalne to locate Assistant State’s Attorney George E. Gorman who prosecuted Scott. The court then asked how long a stay execution was wanted. Stewart suggested a week or longer and Judge David finally Issued an order for an Indefinite stay. Judge David today notified Stewart to have his case ready for hearing within a week. "Under no condition will I grant a continuance," Judge David said. Thomas Scott, Stewart and a group of newspaper men, hurried to Russell’s cell. "It's good news,” the young man’s father said. For a moment Russel could not speak. He stood with head bent low Then he said: “I am glad of that." "Are you insane " a newspaper man sked. “Do you think lam insane7“ Scott countered. ‘‘l don't think so.” “Well, I don’t think so either,' Scott replied. "I am not insane and I am begging no mercy from anyone. I am no more insane than the judge who granted me a stay on that account." Scott will be moved from the death cell some time today and the gallows, waiting for him for eight days, will be dismantled. Mrs. Catherine Scott, who made a final and unsuccessful plea to Gov ernor Small, arrived from Springfield by motor at 7 p. m, and immediately telephoned the Jail. She asked thal Russell be brought to the telephone

Small made this announcement after an open hearing to hear what the defense lawyers said was new testimony. After hearing it the governor and members of the pardon board called Mrs. Scott into private conference.
