THE TYPHOID CASE:— The typhoid fever case which occupied the attention of the Adams Circuit court for six weeks and culminated in a 09,000 verdict for the plaintiff attracted much attention, owing to the fact that it was the first of its kind ever tried in the state. The Indianapolis News thus discusses the decision in an editorial in last evenings editon: — "An award of 19.000 damages in what was known as the Fort Wayne typhoid fever gerins case, seems to be out of the ordinary in municipal legal lore. A resident of Fort Wayne died of typhoid fever. A trust company which was appointed administrator oT the estate sued for 310.000 damages, alleging that the typhoid perms were in the city water as a result of a break in the Pennsylvania line’s mains, permitting raw river ‘ water to enter them: The city main tains a filtration plant and water served to consumers is presumed to be free of dangerous or deadly matter. The case was moved to Decatur, w here it was tried. "The question was largely one of proo&agud the jjjry was convinced of the truth of all the plaintiff's ma teritfl allegations. The typhoid gerre theory was upheld and the verdict established that the burden of care was on the municipality. If a city attempts to furnish pure water to its citizens it is under a legal as wel as moral obligation to see that such ' water is pure.
