Ihrilli was unexpected, ns Mr. Fox was taken ill only four days ago with an attack of paralysis. Pneumonia then developed. Mr. Fox had been mal;iug his home at the Holin Beehler lurui. After deliberat-j itig for twenty two hours, the jury in, tile case of tile state vs. Tom Met- j tier, who is charged with rape, at 12, o'clock Sunday announced that they ! had reached a verdiet. The verdict j wan as follows: “We. the jury, find I Hie defendant guilty of assault and battery only and we fix his punish- j i meat as a tine of S2OO and that he be : imprisoned in the county jail for a period of 6 mouths.” signed George | Barrington, foreman. According to the verdict. Ihe jury' [ could not find the defendant guilty ,of rape, but did find that he was guilty of an attempt to commit rape ' and under that interpretation could | only find him guilty of assault and, ’ battery. While no official statements have been made by the defendant or i his attorneys, they have signified their intention of filing a motion for a new trial. I The case is one that has attracted wide attention and from the time the first session of the hearing was held, on Thursday afternoon, the court room has been filled to capacity with ‘spectators. The prosecuting witness. Edna Bickel, whom Mettler claimed is his bride in a ceremony perform,ed a few months ago in Michigan. I was relied on mostly by the state for ' convicting evidence.
