While Clarence Darrow, chief defense attorney, refused to comment, simply stating he would do his utmost to save the boys from death if they are sentenced to the gallows, Ettelson 'said he felt this would be the second step of the defense. He believes the defense’s first move would be to go before the supreme court and claim error. If both steps are unproductive an appeal to Governor Small will follow, Ettelson believed. State’s Attorney Crowe said that if Justice Caveriy orders life iu jail for the boys the state could do nothing about it- . - i “We have uo power or appeal from I any sentence the court may impose,” he said. “But if he sentences them to death and the defense tries to beat the decision we shall fight to the last.’’ Thomas Marshall, assistant state’s attorney and the indictment expert for Crowe, is preparing’for a possible fight in the supreme court. “There can be no appeal from the facts in the case.” Marshall told the United Press. “Their only chance of an appeal to the supreme court is on a technicality. They may cite errors i in presenting the evidence. Their' »nly purpose in making an appeal j would be to delay execution, for the supreme court would have to uphold the sentence. I shall be ready if they appeal.” CHINA HEARS THREATS OF A CIVH.
