FRANCH BECOMES (Continued from Page One) "Governor McCray files his resignation as governor of Indiana at 1:20 this afternoon to' take effect at 10 a. ill.- April 30, 1924 You will therefore proceed to take such steps as may be necessary to assume the duties of governor of Indiana at thut time.” Mattlnsville, April 29—(Special to Daily Democrat) —Emmett F. Branch, lieutenant governor, will go to Indianapolis tomorrow morning to take the oath of office rfs governor, he announced this afternoon upon re eeipt of word that Governor McCray had resigned. ' The lieutenant governor will leave here at 8:30 o’clock tomorrow morning and will be sworn in at 10 o'clock. McCray's resignation becomes effective at that hour as he appears in federal court for sentence. Prisoner of “Federal Row” Indianapolis. April 29 —(Special to ally Democrat) —Warren T. McCray, governor of Indiana, was a prisoner in the bull pen of “federal row" at the Marion county jail today. Heartbroken and stunned by the verdict of the jury in federal court finding him guilty of fraudulent use ot the mail, the governor was ordered lo jail last night by Judge Anderson to await sentence Wednesday morning. * The governor epent the night in a room with eighty-tour other prison era. Refuses to Comment From the moment he heard the reading of the verdict until the prison doui s closed behind him shortly before 10 o’clock. McCray refused to make any comment on the case, or to indicate whether he would resign I'n m the governorship. Among his friends, however, it was reliably reported that he would voluniat ily quit his office and turn the reins of government over to Emmett F. Branch, of Martinsville, lieutenant governor. It was also stated on good authority (Jut McCray would take nd appeal from the d<-cision of the jury in the United States district court here. Anderson Is Severe In summarily ordering McCray to jail without an opportunity to visit his family.
