tion for the appointment of a receiver, wn- filed in the Adams circuit court yesterday afternoon by William Zwlck against Newton Malching, through Attorney Dore B. Erwin. According to the complaint the plaintiff and the defendant entered into a contract on February 27, 1921, wherein the defendant became tenant of the plaintiff's farm In Root township. 1922, it is said. The plaintiff alleges that the defendant has neglected the farm recently and has violated the terms of the contract, failing to aeI count for much of the proceeds. It is also stated in the complaint that the sum of S6OO is due him from the partnership and that the sum of SSOO is owed other persons by the partnership, but that the defendant refuses to pay the said sums. It was further alleged by the plaintiff that unless a receiver was an pointed, without notice, to take charge of the partnership property and preserve the same, it would be depreciated and wasted and that the defendant would dispose of it and apply the proceeds to his own use. The approx; mate value of the partnership property is said to be SI,OOO. The petition for the appointment of a receiver was submitted fT> the court yesterday after noon and sustained. The court ap-1 pointed John Scheiman receiver and Mr. Sheiman furnished bond in the amount of $1,500. The court instruct-, ed the receiver to make and file an i inventory and appraisement of the property within ten days. In the estate of Allen W. Ross. Charles Ross has been appointed administrator. In the case of Eugene Runyon vs. Frank S. Peterson, suit on a note, the court rendered judgment in favor of the plaintiff for the sum of $216.67. In the case of William E. Fisher vs. Clyde Ramsey and Sim Ramsey, suit on a note, a reply was filed by the plaintiff in one paragraph to the conn ter claim. The case was set for trial on January 3. In the case of Charles W. Henchen vs. James C. Davis, et al, suit for damages killed by the Clover Leaf Railroad company, a separate answer has been filed by the defendant Davis, and a separate demurrer by the defendant Toledo, St. Louis & Western Railroad company to the plaintiff’s amended complaint. In the case of Frederick Busse, the inheiritance tax appraiser, has filed his report, showing that the total net value of the estate was $13,179.41. The estate was inheirited by the widow and no inheiritance tax is due. FOR SURE. MAYBE South Bend, Ind., Nov. 29—There will be a real Thanksgiving in the John Tiernan home tomorrow. Advised by Mrs. Blanch Brimmer, his "mail order bride of a day.” that she had ‘‘given him the bird.” Prot. Tiernan proclaimed to the world that his reconciliation with his first wife was "now complete and permanent" "That setties it.” the professor told the United Press. ‘‘l will never go back to that woman now, Jessie ami I have made up for good and tomor row- we will hold a big family rueu ion. Plans To Break Filibuster In The Senate Washington, Nov. 29. —A plan to break the vigorous anti-administration filibuster tying up all legislative and judicial activities in the senate —was brought into action by republican leaders today. Notice was served that if the filibuster is not abandoned the senate will be held in session over Thanksgiving day until action can be forced on the Dyer bill. This apparently futile move to scatter the little group of Insurgents only met with rebuke and warning from the filibusterers. They answered that the Dyer bill ‘‘shall not pass if the senate sits forever.” Relatives From Distance Attend Rumschlag Funeral Funeral services were held this morning at nine o’clock from the St. Marys Catholic church in this city tor Mrs. Joseph Rumschlag whose death occurred Sunday afternoon. The services were conducted by the Rev. Father Seimetz and were largely attended. Among the relatives from a distance to attend, were five brothers of Mr. Rumschlag, George. Nicholas and Jacob of Tiff on, Ohio; Bernard, of Akron; and Andrew of Defiance, Ohio; John Bucher, a brother-in-law; three sisters of Mrs. Rumschlag, Mrs. Sophia Schwarer, Sandusky, Ohio; Mrs. Peter Lawrence, Tiffin, Ohio: and Mrs. Peter Eshenbrener, Tiffin, Ohio; two nieces Mrs. Clarence Rumschlag, Tiffin and Mrs. Albert Ender. Sandusky; and a number of other relatives and friends. Interment was made at St. Joseph cemetery.
