FIGHT CHARGE Martin Kiefer Declares He is Not Insane and Never Has Been and WANTS A RELEASE Brings Habeas Corpus Proceedings Against T. J. Durkin. Martin Keifer, the well known Preble township farmer, who was declared insane Saturday and taken to jail until he is admitted to the insane asylum at Richmond, declare* that be Is not insane and will make u fight to prove it, asking that lie be released. Late this afternoon, Attorneys Peterson & Moran filed a habeas corpus proceedings in the circuit court, instituted by Martin Kiefer against Sheriff T. J. Durkin. Kiefer sots out that he was not insane when the inquest was held, is not now and never has been, and that j Hie finding and judgment declaring j him so. following the inquest held he- 1 fore Justice J. H. Stone, were not supported by sufficient evidence. He states that he is held by Sheriff T. .1 ' Durkin, on direction of (he county j clerk, based on the findings of the | said inquest, and asks that he be givcn his release. _ o — COURT HOUSE NEWS. It is their opinion that his will ie not strong enough to refrain from wrong-doing. What effect the evidence of these two men will have upon the case is unknown at this time. The depositions were taken by Attorney L. C. Do Voss lor the defendant, and by Prosecutor R. C. Parrish, who were at Columbus last week.
