NAS MADE GOOD New Public Utilities Law Starts Off by Doing Real Things For People PROTECT THE PEOPLE Refuse to Listen to Indianapolis Gas Company Until They Surrender Power. Indianapolis, Ind., June 25.( -Spec- ’ ial to Daily Democrat) —The new public commission of Indiana has lx*en on i the Job long enough to give a fairly safe guess on its accomplishments and attitudes. Regardless of party, politicians and officials of utility companies are inclined to believe that the commission has made good. Its most notable ruling was the ultimatum delivered to two Indianano lis gas companies that wished to merge, the commission declining absolutely to have anything to do with the petition unless the companies agreed to surrender their franchises and with their franchises the rate making power. The commission an nounced that this was the only way the public could be protected from a raise in gas rates if the merger should decide that its increased capitalization demanded higher rates in order that dividends and interest might be paid. The companies at once got “cold feet" on the merger proposition but so heavily involved were certain capitalists backing the ■ proi>osed combination that overtures i were made to get the commission to soften its ruling. The matter still hangs fire today. Another favorable impression came from Chairman Duncan’s attitude toward physical valuation of utilities. The contention of a eor|x>ration attorney that replacement value was the proper standard was bluntly met with ! I criticism from Duncan who declared that the cost of replacing a plant was nor a fair valuation unless deprecia- ■ tion was considered. "It might cost |:>,()iiti.ti(Hi to replace * a plant new," said Duncan, "but if | the present plant is depreciated and run down it would be foolish to value it at the full replacement figure."
