AN ORDINANCE Regulating the use and maintenance of, poles in and upon the streets, alleys and public places in the City of Decatur, Indiana, by telegraph, telephone, electric light, railway, street railway and other companies, corporations. firms .and individual*; providing a license therefor, fixing the fee to be paid for said license and repealing all ordinances In conflict herewith. Section 1. Be it ordained by'The common council in and for the City of Decatur, Indiana, that no telegraph or telephone pole or poles used by electric light, railway, street railway, telephone or other companies, corporations, firms or individuals, shall be erected or maintained in the streets, alleys or other public places in the city of Decatur, Indiana, unless such a license therefor shall first be obtained from the Mayor of said city. Sec. 2. It shall be the duty of every telegraph, telephone, electric light, railway, street railway and all other companies, corporations or individuals, owning or maintaining poles in the streets, alleys and public places in the city of Decatur, Indiana to file with the said Mayor on the first Monday of July, or within ten days' thereafter. in every year, a statement in writing under oath, showing the whole number of poles owned by them in the streets, alleys or other public places In the City of Decatur, Indiana Sec. >. It shall further be a duty of said companies, corporations, firms and Individuals to make a chart, showing the streets, alleys and other public places in the city of Decatur, Indiana, wherein are located the poles enumerated in the statement herein provided for, and indicate accurately the position of each of said poles, and file the same as a part of said statement Sec. 4. It shall be lawful for the Mayor of said city to cut down and remove at any time after said statements and charts have been filed, all poles not returned as herein provided.
Sec. 5. Said companies, corporations and individuals shall, on the first Monday of July or within 10 days thereafter, in every year, make application to the mayor of said city of Decatur, for a license to maintain the poles owned by them in the streets, alleys and other public places In said city, for the ensuing year. Sec. 6 Said companies, corporation, firms and individuals shall pay into the city treasury for the use of said City ot Decatur, Indiana, on the first Mondav of July or within tan days thereafter of each year, tha sum of 25 Cents annually for each and every pole for which a license shall be granted in accordance with the provisions of this ordinance Sec. 7 If the said Mayor shall not be satisfied as to the correctness of any statement so made by any company. corporation, firm or Individual, be shall have power to require the. principal officer or any officer of said company, corporation, firm or individual to appear before him with .books and papers and submit to an examination concerning said matters. If it sba’l thus be ascertained the full number of poles in use has not been returned as above provided, he shall or-1 der the company, corporation, firm or individual in error to pay into the city i treasury forthwith the deficiency ascertained by said examination. See. 8. Any company, corporation. | firm or individual violating any of the provisions of this ordinance shall, upon conviction thereof, be fined in any I sum not exceeding one hundred dollars nor less than twenty-five dollars, and each day s default in procuring said license, as hereinbefore provided, shall constitute a separate offense. Sec. 9. All ordinances or parts of ordinances or resolutions heretofore made or ordained and passed, in conflict with the provisions of tills ordinance are hereby repealed. ~Bec. 10.
