Ail Caused By a Wash-out Bridge, There was an interesting time in the Circuit Court this morning The jurors siit in their seats waiting to hear the evidence in the suit brought against the I Monon railroad by John Ward, of Montgomery county, who, a year ago last

September, boarded a freight train at Linden and told the conductor that he wanted to go to Raub Station. He was informed that, the train did not carry passengers and did not stop at that station, and when liatib Station was approached Ward said he was going to jump off because he had. an important matter to attend to. He was warned by the brakeman to remain on the train but he jumped, however, alighting on his head. So he wants £111.000 damages alleging that he was thrown from th, train by a sudden lurch of the train, but ou the contrary the trainmen allege

I hat he jumped voluntarily. Hon. •loLin b\ McHugh is attorney for the railroad and John 11. Courtney, of Crawiordsville, brought the suit tor Ward. Judge Lnngdon was on the bench this morning waiting for the presence of the two Johns. Mr. McHugh was there, and Wiird, the plaintiff, sat in the opera chairs with a number of auditors. The case was called. Mr. McHugh stilted that the deleudant was ready for trial and then read a telegram from Mr. Courtney at Crawfordsville announcing that there was no train to Lafayette until this afternoon. Judge Langdon understood different and Mr. McHugh telephoning to the Big Four freight offices learned that the train on that line arriving here at something after 9 o'clock from the east connected with the Vandalia train from Crawfordsville at the town of Colfax. This put Mr. Courtney's telegram in a bad light.

Mr. McHugh drafted an affidavit ensconsed in a motion that the case be dismissed by reason of the fact that the plaintiff's attorney had defaulted. At this stage Ward rushed out of the court room to secure another attorney but when he came back the case had been dismissed and the jurors were discharged until next Friday. Mr. McHugh was not satisfied and telephoned the Big Four freight offices again. Was it possible! He had misunderstood the boy at the other end of the 'phone. The reason Courtney had not come was because thero had been a bridge on tho Vandalia washed out and no trains were running on that line. 'To set matters right and undo the wrong a misinterpreted telephone had done. Mr. McHugh explained tho true state of affairs to Judge Langdon. The jurors had nearly all started home but were ijuickly gathered in again anci the case set for 2:o0 this afternoon.—-LaFai/cite Courier. —-T. II. Courtney has dismissed the

The Republicans of Waveland nut Saturday evening in mass convention to nominnte a town ticket. The candidates selected are as follows: Council man for W7est Ward, P. K. Smith East Ward, T. .1. Canine Clerk, M. IjButcher Treasurer, Penn Hanna. There was quite a spirited contest in every case except that of lerk, for which ollice Mr. Butcher was unanimously chosen. Another ticket will probably be put in the field.
