Yeager said at his his first visit patieut was nervious and in somewhat of a chill, stomach in a ted uud patient was vomiting at second visit he learned that she had been troubled with malaria prescribed medicines and on his next visit thought she was getting well. At tho uext visit which was Tuesday she was worse. The diagnosis was that it was mulariul poisoning Dr. Yeuger suggestjd and also witness, that sue had typhoid svniptoms it is a fact she had typhoid symptoms. Nux vomica is commonly found in the pills givou the patient. Dr. Yeager said he hud not given quinine in sufficient quantities as patient did not like to talte it. The cause of the stupor was the result of malarial poisoning, not anesthetics because it lasted too long for that at that consultation calomel and oil wero prescribed the calomel was to be given immediately (4 o'clock) and tho next dose in three hours the oil was to be given 1 hours after the last dose of calomel gave Pettit instructions to put whisky in oil and have it warmer! whisky and oil need stirring to make them mix Dr. Yeager never mentioned strychnine poisoning at corsultatiou neither did he mention convulsions

Pettit it was about 10 o'clock and witness immediately drove to Shawnee Mrs. Pettit had been dead a half hour when he arrived witness was subpoened by the State and was here in response to it ready to testify saw a case of ideo pathio tetanus at Indianapolis in 1873 since JiJy 17, 1889, have not seen Dr, Yeager until this trial began. The eyes of Mrs. Pettit were closed in death
CROSS—While waiting for Yeager that night did cot go to sleep. On tue habeas corpus witness testified there was no rigidity of arms or legs and it is true. Don't know positively that the patient was not under the effect of anestheties. They might have administered while witness was there but hardly probable. Don't know that mix vomica was given the patient. Testified before the first grand jury Nov. 12, 1889. If witness testified then that he received a telegram at 12 and arrived at 2 he was mistuken. Does not remember at the habeas corpus of answering tho question whether Pettit told him about giving the tea and of the convulsions and of saying to Pettit "Yes,Dr. Yeager mentioned them," in the negative no1of answering the affirmative the question whether Pettit did not mention this at all but that Dr. Yeager did.
At second grand jury don't remember whether his testimony at first grand jury was read to him or not but it was mude apart of his testimony then. Witneess thinks he mentioned the stiffness of the bowels at the habeas corpus. May have used the term "relaxed" in regard to the condition of the body at the habeas corpus and before the second grand jury. (The question as to the conversation between witness and Pettit before Dr. Yeager arrived Wednesday morning was objected to and the objection sustained.) Dr. Yeager said he noticed fever first on Tuesday morning a history of the case was given witness before Dr. Yeager arrived but not in full Pettit gave him the history the defense asked the witness if anything beside his own examination and Dr. Yeager's information influenced him in making a diagnosis of the case and witness replied in the negative. Pettit said she had symptoms of malaria before she went to South Bend and was still suffering from it when sh returned. Nothing was said about convulsions or poisoning
RE-DIREOT.—Witness did not ask Pettit for a history of the case. Yeager said he hud given dignitatis and a pill containing morphia and atropia did not mention aconite.
RECROSS.—Yeager mentioned bromide of potassium, hydrate of chloral and chloroform.
RE-OBOSS.—Was at the parsonage about 15 minutes on Wednesday don't know where he went from there but went south. Spoke of the typhoid symptoms at tho habeas corpus but maybe not before the grand jury. The doctor was then excused.

Went east with Pettit and his wife's body. On the night of the return staid all night at the Lahr House with Pittit, Pettit asked witness to tell David Meharry to send his buggy to West Point for liim witness did so the witness then identified a letter of ins own to Mrs. Shields in answer to her letter of inquiry. The State objected to its being introduced as evidence and were sustained. The defense took exceptions and excused the witness. The defense then made a call on tae State to procure Dr.O'Ferrall. They announced tnat he would be here in few minutes coming on tho train, but just then a letter was handed to Hay wood from him announcing that ho was very ill and threatened with pneumonia. Kumler said the defense wanted him for cross examination aud wanted him bud. IIaj'wood said he would try to have him Monday. Kumler th said the defense was unwilling to proceed uutil the examination of O'i'Y-rrall was complete.

Bromide of potassium taken internally or chloroform inhaled would probably have no effect on the congestion of the brain.
CROSS.—In case of death by strychnine it would be detected in nearly every tissue of the body it is more likely to be found in tlie secretory organs there can be a case of death by strychnine wben there is no congestion of the brain the presence of strychnine in the brain is to be expected a case where congestion is not found Avculd be anomulous. Don't know what causes the congestion. A patient dying in a strychnine convulsion would die of asphyxia strychnia is the cause of the congestion much more than the convulsion" Congestion if the brain may be caused by strychnine without convulsions the kidneys and liver are the chief organs of elimination, the perspiratory organs to a limited degree. The perspiratory organs could eliminate comparatively no strychnine. If the patient's urinary organs were iu good order a dose of strychnine given on Sunday would not be fouud on Wednesday. If it did stiy would expect to find it in tho blood and tissues absorbed one-half grain may cause death and seven may not. If severe vomiting was produced on Sunday and the urinary organs in nrder on Monday would say the chances of finding strychnine on Wednesday iu the body were very slight therd is no liklihood of a person inhaling a toxic dose of strychnine traumatic tetanus results from an injury to the terminal nerves it is commonly called lockjaw in case of doubt between strychnine poisoning and tetanus proper in which a cheaneal analysis revealed strychnine would decide that it was strychnine poisoniug as far as it went as testimony. Anderson and tho witness here had quite a discussion as to the mode of the approach of convulsions which ended in the witness saying: "See hero sir, I demand that I shall answer your questions

A half graiu in a cup of oil would make it very bitter also, Along hypothetical question including the sickness and death of tho patient was put the witness. The symptoms mentioned, witness said were not those of strychnia poison alone death might reasonably be ascribed to exhaustion from tetanic convulsions. A second hypothetical qviestiou covering the em balmiug, the exhuming aud analysis was put and witness said he would not conclude beyond a reasonable that strychnine was the cause ot death.
