TRAGEDY IN OOUBT.
The Court Eoom at Danville the Scene of the Affair. Coley Brown, president of the Lebanon Natural Gas Company, shot Samuel Wesner, a prominent Lebanon attorney, at noon on Saturday, and Wesner died almost instantly. The Bhooting occurred in the court room in Danville in front of the judge's desk. For several days a suit—Martin Ilohe—against tho Lebanon gas company for damages has been on trial, and has been bitterly contested on both sides. The argument had boon completed and the court had adjourned, and Wesner was laughing and talking, pleased over tho conduct of the case. Wesner was told that he must look out for Brown, and he replied that he heard that Brown had a revolvor last night, but ho was not afraid. Brown then came from the side of tho room where he had been standing, muttering threats against: Wesner. They met and Brown said: "My reputation is as good as yours." One word led to auother, and Wesner said: "If you Have a gun, pull it. I dare you to."
Brown meanwhile had his harrdj behind him, and it IB thought that he transferred the revolver from his left to his right pocket. Upon the word, Brown drew his revolver and fired two shots. Almost instantly Wesner moved toward Brown and pulled a long dagger, and just as he laid hands on Brown, Brown fell and Wesner was taken off and laid down. Brown was arrested and his revolver was taken away from him. Wesnet's strength began to fail and ho died in forty minutes. Brown was taken to jail, and is not disposed to talk, although he says Wesner provoked the matter.
Brown was badly cut across the palm of his left hand by the dagger which Wesner used.
The first ball fired struck Wesner in the left forearm and came out near the elbow. The second ball struck near the base of the breast-bone and ranged downward, showing under the skin about four inches from the base of the spinal column. The weapon was a 32calibre Smith & Wesson self-cocking revolver. It is a five-chambered weapon, and now contains two loaded shells, two empty ones and an empty chamber.
The trouble arose over Wesner's comments on Brown's evidence in the trial.
Mackessy Found Guilty.
The jury in the case of the state vs. William Mackessy, radicted for assault and battery with intent to murder George P. Rudolph at Lafayette, was out from 5 o'clock last Friday until 11:20 Saturday forenoon. At that hour they came in with a verdict of guilty of assault only, and fixed his punishment at two year's impriso'-l^J-it and a fine, the lowest sum allows ,jy law. Judge Langdon ordered the jury to return to their room and complete their verdict by putting in the amount of the line. In response to a juror's inquiry as to the extent of the fine, the judge said the statute fixed the amount at any sum not exceeding $2,000. On their return the jury fixed the lina at 81.
Mackessy was the third one of the -rioters to be tried. Three witnesses swore to seeing him shoot at Rudolph, and ho had no defense, not even testifying in his own behalf. The general opinion iB that Mackessy was but a tool of the others, he being intoxicated on tho night of the riot. The defense polled the jury, each juror answering that this was his verdict. The defense then asked the jurors if they wero still satisfied with the verdict. The State objected and the Court sustained objections, to which tho defense excepted.
The fight in the jurv-room was over tho question of jn'niphmcnt, two jurors thinking a jaii sentence of a few months sufficient,
LaPearl on the Road,
LaPearl's show is doing a splendid business in Illinois. The Lincoln Courier in which city of that state it exhibited last week, says:
For two and one-half honrs this afternoon the young were delighted and the old impressed favorably with the sterling acts of ono and all—humans and animals.
The show has a new canvas, new fix: lures and trappings for the performers, making the interior quite attractive. The special features are tho marine band under Prof. Vandercook—a splendid musical military organization. We have not the space to enumerate tho different acts beyond the bare mention of Master Harry LaPearl, Hoy LaPearl and Miss Carmen. The entertainment following the show is a novel combination of mirth, melody and music.
The show is at Roodhouse, Illinois today, and is maving toward tho southern portion of the state.
