Parnell Refuses to Answer tho Charges of Captain O'Shea
FHE LATTEirS DIVORCE. SUIT BEGINS.
The Story of the Intimacy of the IlotneKule Leader nnil Mrs. O'Shea Aired In Court—The Silence of the
Defendants/
I'AHN'F.Ll. ACCUSED.
LONDON, NOV. 17.—The O'Shea divorce Juit came up for trial Sat* rday in the divorce court. .Mr. Justice putt presided und a special jury hy been impanelled to try the ease 'l'he courtroom was densely crowded vvith relatives and friends of the parties to the suit and a throng of curious spectators. Messrs. Clarke, Inderwick, Lewis and Coward appeared as counsel for tho plaintiif, Captain O'Shea, while the respondent, Mrs. O'Shea was represented by Messrs. Lockwood and Pritchard. Mr. McCal.l was present to take charge of the interests of Mrs. Steele, sister of Mrs. 0 Shea. Mr. Parnell was neither present nor lepresented by counsel when the court opened and the only prominent person connected with the case as a principal present was Captain O'Shea.
Counsel for the respondent, Mrs. O'Shea, stated that it was not his intention to cross-examine any witness or call witnesses on the part ot his client, nor should he participate in the proceedings. An immense sensation was caused by this announcement, as the action of the defense condemns Mr. Parnell to very heavy costs.
Mr. Clarke, of counsel for Captain O'Shea, in calling attention to the changed compl xion of aifairs, said that the prosecution found itself in court with neither respondent nor correspondent to participate in the conduct of a defense In response to a question by Justico Butt, Mr. Clarke said that the cqunsel for the plaintiff had been unable to find that any oue was in eouro to appear for Mr. Parnell, and that the suit would therefore seem to be '.indefenled. Continuing, Mr. Clarke said that Jnotwitbstanding the decline of the defense to proceed, be nevertheless felt it necessary to prove the strength of his client's case by the presentment to the court of sufficient evidence. The respondent, Mr. Clark said, bad made sweeping countercharges .-•* against her husband, alltging cruelty, connivanee and adu^erv—the latter offense having, she affirmed, been endured during a eriod covering several years. Her ,ea was, counsel for the prosecution claimed, almost tantamount to a confession. Captain O'Shea would, counsel asserted, easily prove the untruth of all the defendant alleged, and especially the charge of connivance in her infidelity. It would also be shown that when Captain O'Shea first heard
lof
wife with the correspondent, Mr. Parnell, ho promptly challenged that gentleman to aduel. The prosecution would prove beyond cavil the commission by the defendants to the suit cf continuous acts of adultry it would rtow that, under the name of "Smith," v'r. Parnell had visited his client's wife the Bedford Square residence.
Mr. Parnell, he said, could not face •{e evidence. He allowed judgment to by default, because he dared not go nto the witness-box. The criminal iaw had terrors for some people whom the moral law could not bind. He did not wonder at Mr. Parnell's refusal to answei the charges of faithlessness and falsehood and betrayal of the friendship of the man who was trusting him.
Nothing excited Captain O'Shea's suspicions until 1SS1, when Mr. Parnell visited the respondent at Kltham. His annoyance over Mr. Parnell's approaches to his wife led Captain O'Shea to send the challenge to Par•k«sll. Mrs. Steele saw Parnell, who fissured her there was no ground for Jealous suspicions. O'Shea wrote to' Parnell and the latter replied that he had answered through the assurances he had given Mrs. Steele. Afterward affectionate relations between O'Shea and his wife were continued, and Parnell was again invited to Eltham. In
1882,
after Parnell had been
released from Kilmainham jail, he renewed his visits to Eltham and almost habitually slept there.
Captain O'Shea wroto to his wife, remonstrating against these visits, and declaring bis intention of vacating his Mjat in Parliament. Furious scenes occurred between him and his wife. On mo ocoasionhehaa found a portmanteau belonging to Mr. Parnell at his house.
Mr. Clarke went on to assert thatduring thirteen weeks in 1880 Mr. Parnell and Mrs. O'Shea occupied together a house in East Bourne, and afterward, for a shorter period, another house in Uie vicinity. After Mrs. O'Shea had promised her son to adopt a new course gentleman calling himself Fox went to a house agent and engaged a house in Brockley. Tho gentleman afterward changed his name to Clement Preston. He was Mr. Parnell, and Mrs. O'Shea was frequently at the house. She announced herself as Preston's sister. At another time Mrs. O'Shea took a house at Regent's Park, giving as her refers ences Clement Preston, of Broekley, and Mr. Parnell. Thes» (aots proved that the concealment ot identity was kept up to tho lc:?v moment and cleared Captain O'Shea of the charge of connivanofe. Tho respondent and co-re« spondent used this house together front 1887 to 18S9, she calling herself his sister.
Captain O'Shea, Harriot Bull and Caroline Peters gave testimony corroborative of tho charges made in Mr. Clarke's speech, and the court adjourned until to-day.
