I.aBt Saturday Judge Langdon delivered bis decision, ot which the following is a full text: "This is an application to be let to bail. Tbe petitioner aud one Alma C. Whitehead are jointly indicted for murder in the first degree. Section 18 of the Bill of Wright says: 'Offenses other than murder rnd treason, shall be bailable by Buflicient sureties. Murder or treason shall not be bailable when the proof is evident, or tiie presumption strong.' _I have carefully observed and heard the witnesses and the evidence, aud I am constrained to declare that the case presented does not show one bailable within the terms of the constitution of the state. The motion to strike out is overruled, and exception, the prayer of the petitioner is denied, aud the prisoner is remauded." Defendents excepted to the ruling of tne court— First, on the motion to strike out the declaration of Mrs. Whitehead second, on the motion to admit to bail third, they pray an appeal to the supreme court fourth, pray for sixty dayB to file bill of exceptions, which is granted.
