THE necessity of a new cemetery is •trongly agitating our citizens. The fact that many of our leading business men have taken hold of the matter in earnest, is evidence that the old system «f surrounding the city with grave yards is to be abandoned, and that in time Crawfordsville will have the most beautiful cemetery in the Mute.
WARD school houses are a necessity that our cititens are beginning to appreciate, and sooner or later they must be built. The congregating of all the children in our city in one school house is an evil that demands prompt attention from our people, and should be remedied at the earliest opportunity.
LAST Thursday evening two more souls were made happy, and the Printer's heart again made glad by a bountiful remembrance. It was our friends Warner Wilhite and Miss Mollis Sidcner, this time. The o«r«mony was performed by Rev. R. F. Caldwell, at the residence of the bride's fathtr, Mr. James Sidener.

BELOW will be found a decision rendered in the Common Pleas Court of this county, by his Honor, Judge Ristine, which we think will not be without interest to many of our readers. Samuel 0. Good applied to the Board of County Commissioners for license to sell intoxicating liquors in less quantities than a quart at a time, in the town of Waveland. His application was resisted by the citizens of that town, and the Commissioners refused to grant the liccnse. Good appealed to the Common Pleas Court. After listening to the evidence and the arguments of counsel, for and against, the following decision was read by the Court: Samuel 0. Good

T. L. H&nna et al. This case is here on an appeal from the board of Commissioners on an application made by the plaintiff for a license to retail intoxicating liquors. The Legislature, in its wisdom, by an act approved March 5, 1869, made lawful the traffic in intoxicating liquors, under certain specified restraints. This ease is governed wholly by the provisions of Sections 3 and 4 of the Temperance act. No controversy arises as to the legality required that such application would be made, or over any of the preliminaries essential to the proper presentation of the application for the consideration of tho board of Commissioners. The only question before this Court is—Is the applicant under the sections 3 and 4 of the law, to entitle him to be licensed for one year, authorizing him to retail intoxicating liquors? The expediency or inexpediency of granting a lieense is not a subject for the consideration o? a Court or jury. The law must govern in opposition to the opinion of any particular community, and the granting of a license depends wholly upon the judgment of a Court or the finding of a jury upon the qualifications of the applU cant, as prescribed by sections 3 and 4 of said act. Section 3 grants to any inhabitant of the township where such business is to be carried on, the privilege of remonstrating in writing against the granting of snch license to any applicant on account of immorality or other unfitness.

that the board of Commissioners, before a license shall be granted, must be satisfied that the applicant is a person of good character, and fit to be trusted with such license. The county board refused this applicant a liccnse and the cause is here on appeal for the determination on this point. The legislature in the enactment of the temperance laws fixed no specific moral standard by which Courts or juries shall be governed in such cases. The human mind is so constructed, and society is so organized, that it is very hard to find any two persons who can agree upon the moral status of any particular individual.
All will admit that the commands pronounced in Holy Writ, Thou shall not steal, nor bear false witness against thy neighbor,*' etc., etc., is a true and just standard may we not ask who of the men of this or any other age has filled the measure of this standard? The evidence iu this case conflicts as to the good character and fitness of the applicant to be trusted with a license for the business he is desirous of pursuing. Good men, men of worth to the community and to society, testify of the unfitness, in their belief, of the applicant to be entrusted with a license, and of his immorality. The principal facts testified to, showing the immorality of the applicant, consisted in showing the habit of profane swearing, the recital of smutty stories, and a disposition to boyish rowdyism yet some of the witnesses thus testifying, in whose employ the applicant had been for several months, testified that he was industrious and honest. No evidence was produced that the applicant was of a quarrelsome disposition, that he was ever charged with breaches of the peace, or other violations of the law, or of drunkenness. It is a national historical fact, mortifying as it may be, that many of the eminent men of our country, some of them honored with the highest positions, sometimes-indulge in profanity, and in the recital of smutty stories, and if rumor be true, have been seen in a state of intoxication. The. evidence of the .unfitness of the applicant to pursue the traffic in liquors rented mainly upon a want of stability of character, and made in sueh general terms, too vague and indefinite to satisfy the Court of unfitness on this ground. The testimony produced by the applicant in support of his claims comes principally from young men with whom he most associated the testimony in his behalf gave to the applicant a very fair reputation. About three years seems to be the period he has been a resident of Rockville and Waveland, a period long enough to give an exhibition of his prominent characteristics.
Taking the testimony altogether, we think there is nothing shown that would warrant the coneluson that the applicant would violate the law—thi« law particularly, with its atringent restrictions and heavy penalties, imposed for the protection of the public. After a careful examination of the, testimony, and duly considering the same as a whole, with our views of the law we cannot but oonclnde that the applicant is a fit person to be entrusted with a license.
The caae was ably presented upon both •ides, Hurley and Patterson appearing for the applicant and Butler, Wallace and Johnson for Remonstrators, and excited considerable interest.
