Can it be that Justice Chase is jess able intellectually than any of his predecessor®?—that he posscscs less judicial discernment?— that he, iu a word, so lacks tho essoutial first qualifications for a position 011 the 'bcuch of the court, that bis fellow judges have no respect for his opinions? We can not believe it. Mr. Chase, whatever else may be his shortcomings, has never been accused of a lack of a fair share of ability. J'erhaps it is uot too much to say that he is not surpassed in this respect by any tiiember of his party.
What, then, is the cause of his disreputable showing in every important case on which the court is called to act? His fellow judges are all, with one exception. Northern men. A majority of them arc appointees of Abraham Lincoln. Vet on their sworn oaths, in the discharge of their high duties as judges in a tribunal whose decisions have long enjoyed a world-wide repute no less for their ability than for their unquestioned integrity and superiority to, all improper influences, these jnidgcs, so appointed, can not 011 many important questions go with their chief'. He is regularly left to dissent— and to disseut, it is proper to add, in favor of the radicalism of the day, which bis fellow-judges, members though they are of the same party, find it impossible to uphold wheu it comes to a decision ou
