SKC. 1, Ho it nrdaincd by the Common Council of the city of Crawfordsville, That the Cincinnati, Indianapolis and Danville Railrund Company be nnd tho same lShercbyiautliorizcd to construct a track for said railroad within the limits of the city of Crawfordsville. and for that purpose, tho right of way over across and along the streets nnd alleys within the' corporate limits of said city is hereby granted said railroad company.
SKC. 2. The right of said company to construct and maintain a track through the city of Crawfordsvillo as aforesaid, is subject to tho conditions and terms following, that is to say 1ST. This grant shall not be construed to interfero with the private rights of the owners of real estate over which said road may bo located, relative todnmages for rueh occupancy and appropriation thereof but it is made subject thereto,

When said track crosses any street, or alley it shall be made to conform strictly to the grade of such street or alley, as heretofore established by the city authorities, unless the C( ininon Council, upon the application of said company,shnll consent to a variation from s" id grade. 3d. At the crossings of streets and alloys, said company shall lay said track in such a manner that it shall cause as little obstruction as possible to the uso of snid streets and alleys for tho 'passage of wngons and other vehieles.nnd shall plank said track between tho rails at all such crossings, and two feet on each sido of such mils, tho entire width of such streotg or alleys, and shall also plank orcravel the sidewalks whero they may cross said railroad, and shall also inuho ««iri crossings safe and convenient for the passage of persons _„i.i„ioa „„,j

Said company shall construct and continually keep in good repair, under and on the line of said track, at such points as may be deemed necessary by tho city Engineer, or other officer of tho city, under the orders of the Common Council, sufficient culverts and drains to admit the free passngc of water along and from tho streets aforesaid. 5th. All nets and things above required to be done by said company shall be done immediately after tho laying of said track across such streets, alleys or sidewalks aforesaid, and in case the said company shall fail to putsiiL'ti crossings in the order above required, or to keep the smne in repair, or

Whenever said track of said railroad company is located within tho corporato limits of said city, .^hcn tho right of way, granted iiTseetion 1. is relintJUished by said company, except on the streets and alleys so used by said company in the location of said track.
SEC. 3, In case said railroad company shall fail to comply with each and all of the conditions of this ordinance herein set forth, the said right of way herein granted, shall forfeit to'stri city of Crawfjcdsvillc. and tho railroad tracks bolonging to said TOtnpany may at any time thereafter bo removed from the limits of thccity by order of said Common Council and furthermore, in case said right of way bo transferred, said transfer shall bo subject to all the conditions set forth intthis ordinance.
SEC. 4. No more than ono track for said road shall be laid across any street without the previous eonsont of the City Council.
SEC. 5. This ordinanco shall be in forco whenever tho same shall be accepted by tho President of said railroad company for said company and a copy of said acceptance, in writing, shall be filed with tho Clerk of the cjty of Crawfordsvillo and shall haroibosn published, with, said acceptance, for two successive weeks in tho Crawfordsvillo Review,
