Skc. 4. Fhat the privilige hereby granted are upon consideration that said John G. Miller A Co., their associates, successors or assigns,'shall on or before tho first day of March. 1800, commSjico and diligently prosecuto tho construction of said works for tno manufacture of gas .of sufficient capaoity to supply the said City, and 'inhabitants thereof with gas. and shall complete the same on or before the nrs^ay of July, 1866. Any temporary failure on their part to perform any of the conditions heroin required of tnem. except as to the commencement or completion of the works, shall not work a forfeiture of the privileges horoin granted, provided that such condition on their part accopted bo complied with within a reasonable timo.

SEC. 5. That if any person or porsons shall unlawfully and maliciously injure, romovo or destroy any gas lamp post, gas pipo, gas lantern or gas fixture in any street, lane, alley or other public grounds, Every such person so offending shall on conviction thereof be fined in any sum not exccoding Fifty Dollars, to be rocovered by prosecution before tho Mayor it said Oity. or by oivil notion, before any court in tho State of'Indiana.

SKC. 6. That the Council of said City shall hffVo the privilege at the expiration of tho'term of 20 years, before mcriSionod, Dy giving one yeati notieo in writing, of purchasing from said John G. MUlor A Co., their associates, suceessorsl.or. assigns, for the uso of said City, all tho buildings, pipos, apparatus and privileges constituting the said gas works, the price of which shall be determined by fivo disinterested persons two of whom shall bo chosen by the Couneii, two by the Co., and the fifth by thfffour so chosen, and should the Council decline to purchase saia gas works at tho oxpiration of 20 roars, then the privilege borein granted shall be continued for a further term of fivo years.

Sec. 7. And it is further ordained that in consideration of tho privileges herein granted, the said John G. Miller A Co., shall subscribe to tho capital stock of tho said company horeaftor to bo organized for the purposo aforesaid, the sum of fivo thousand dollars, and that the said City shall, havo tho privilege of subscribing to the capital stock of the said company to be'organizod, tho sum of fivo thousand dollars conditioned upon a voto of tho citizens of said City to bo heroaftcr taken.

Skc. 8. This ordinance shall tako effect and bp in force from and aftor to passage and legal publication.

equal to nine sperm candles from a five foot burner at a rato not oxcoeding four ($4) dollars per thousand cubic foet. and shall put up 20 lamp posts with lamps nlong the streets wnero tho main Gas pipe may bo laid, wherever the Council may direct free of all chargo whatever. Tho inhabitants-of said City to bo furnished with Gas of tho same quality, and subject to the rules and usages regulating Gas companies in the State of Indiana. The Metres to bo furnishod by the consumers or rented'of the Gas light Co,, as tho former may prefer. The said John G. Miller A Co., their associates, successors- or assigns. are to conform to any and all regulations which may be hereafter established by law either as to quality of Gas furnished or otherwise, and they shall nave exclusive right to lay down and maintain their own gas pipes in said streets, lanes, alleys, or other public grounds for the period of 20 years from the taking effect of the ordinance.
