SEC. 4. That tho privilige hereby granted arc upon consideration that saia John G. Miller 4 Co., their associates, successors or assigneos, shall on or before the first day of March, 1860, commence and diligently prosecute the construction of said works for the manufacture of gas of sufficient capacity to supply tho said City and inhabitants thereof with gas, and shall complete tho same on or before tho urstjday of July, 1866. Any temporary failure on their part to perform any of tho conditions herein required of them, except as to the comuiwj'-'ineiil or completion of the works, shall not work ^forfeiture-, of the privileges herein granted, provided that sudU condition on their part accepted bo complied with within a reasonable time.

That if any person or persons shall unlawfully and maliciously injure, romove or destroy any gas lamp post,gas pipo, gas lantern or gas fixture in any streot. lane, alloy or otlior public grounds, ry such jJorson so offending shall oh conviction roof bo fined in any sum not exceeding riftf Dollars, to be recovered by prosecution bcloro the Mayor'of said City, or by civil action, before any court in the State of Indiana.

That the Council of said City shall havo tho privilcgo at the expiration of tho term of 20 years, before mentioned, Dy giidjig one years notico in writing, of purchasing fronrsaid John G.Millor 4 Co., their associates, snocessors or assignees, for the use of said City, all the buildings,pipes, apperatus and privileges constituting the said gas works, the price of which shall bo determined by five disinterested persons, two of whom shall bo choson by tho Council, two by the Co., and the fifth by tho four so choson, and should the Council dcclino to purchase said gas works at tho expiration of 20 years, then tho privilcgo herein granted shall bo continued for a further term of live years.
SEC. 7. And it i» further ordained that in consideration of the privileges herein granted, tho said John G.
