And thereupon the said Plaintiif by his attorney, files the following aflidavit. to-wit: insert it from which said atlidavit, it is shown that David Frame one of said defennnts, is not a resident of the State of Indiana, and that he is a necessary party to an action in the Montgomery Circuit Conrt, in relation to reai estate.
