A couple of 'Sundays ago some one entered the residence of Mrs. Sanders, a colored lady and nipped several pies and a 815 ISible. What a burglar would want with a ISible we cannot divine, unless he would use it to press autumn leaves or to put on his Sunday pantaloons at night to keep the creases plain. Kut the Bible was taken and Mrs. .Sanders finally became convinced that .lohn Davis, white man. had stolen it. Constable Byers, the colored emissary of the law yesterday afternoon swore out a warrant against Davis and arrested him. Davis refused to go to jail and breaking away ran off. Constable Byas followed and drawing his pistol attempted to end the career of the alleged Bible thief, '(1 pulled old sister trigger four times.'' said John, but she never said a word."

There were not enough subscribers to make it go in the residence portion of the* city so the projccters gracefully retired. From present prospects the dust will rise this summer in louds all over the city to settle .on fresh painted houses, and pretty lawns and to cause the pedestrian to swerr when lie is passed by a wagon. A freat number wlu have heretofore been sprinkling the streets in front of their residences, will desist this season because of the very high water rates.

Last evening was the stated time for the oratorical contest between the Wayman colored Literary Society of this city and the Douglas colored Society of Danville. 111. The Danville orators, Messrs. Wade and Hoffman, arrived yesterday afternoon, attired in their gallantry and good clothes. They did not look like victims but they were. They were marked men. For several years it has not been considered etiquette to sail out and meet your gnests with hickory clubs and some people have gone so far as to deprecate the habit of knocking your guests down at the front door, kicking their skulls in, firing them out the back door and setting the bull dog on them. The pink and white equitettc must often get off the track while the cannon ball of necessity shoots by. It was just that way last night. It was necessary for those folks from the salubrious climate of Danville to leave their bones (metaphorically speaking) to bleach on the arid plains of Crawfordsville. The Waymau orators wanted that debate. The A. M. 12. church was crowded at the appointed hour and every candidate in town was conspicuously present, all of them refusing to take change for a quarter at the door. Gen. Wallace was called to preside over the convention and the following judges, good and true, were sworn to hear the argument and a true verdict render: Ex-Councilman t. W
L. Brown, Postmaster Voris, Manager Mace Townsley, Judge Isaac Davis, lion. Henry 1). Vancleavc, Dr. J. R. Etter and Councilman Robinson.
The question was "Resolved, that tlie negro voters should divide their suffrage.The Wayman had the negative and right nobly did her champions go after the bacon of those fellows from the wild and wooly West. Messrs. Wade and Hoffman both fought well and died game, but they died. When the fierce phillipics of Mr. Drake descended upon them their arguments were scattered like snow flakes in the winter's windii Even had the eloquence of Mr. Drake not sullieed there would have been no withstanding the potent •'liokey-bos'" of Prof. Robert Burton, who had his whole famous collection with him, including the celebrated live frog and the talismanic 'possum foot which when touched has never failed to bring forth the desired "seben-leben." Prof. Burton's argument was also a thing of beauty and went straight to the heart. At the conclusion of the argument tlie judges retired and soon returned a verdict in favor of the Wayman. the vote stand' ing 5 to 4. Great enthusiasm prevailed and the occasion ended happily. Col.
Drake and Prof. Hurton received the eongratulations'of all for their splendid work and for proving that they were bushwhacked out of a favorable verdict last week on the bloody sands of Danville.

The local Christian Endeavor Union in conjunction with the State union has arranged for a course of missionary lectures, to be delivered at various times by some of the most prominent missionary leaders of the day. The first lecture in the "Missionary Exten sion Course." was delivered by Mr. S. L. Mershon, of Chicago, at the district convention held here a short time ago The second address will be given this evening at Center church by the Rev. 1'. (!. Coan. a returned missionary from Persia. Mr. Coan's subject will be 'I'ersia. as Typical of tlie World's Evangelization." lie comes with strong recommendations as a speaker and an authority concerning his chosen work. There will be no admission fee charged to this or any lecture in the course, and a hearty invitation is extended to all people to attend. The lecture will begin at 7:30.

As stated in yesterday's Journal Ward Burrows was granted anew trial by the Supreme Court. Burrows will be brought here at once by the prison authorities and delivered to Sheriff Davis. It is more than likely that the larceny case will be taken to Logansport and be tried for forgery.
The opinion, which written by .ludge Dailev. was handed drtwn yesterday, and reverses the Montgomery circuit's finding and orders a new trial. It holds that the fifth instruction of the judge of that court to the jury in this case was altogether erroneous. This instruction was as follows: "A cheek drawn on a bank when the drawer has money on deposit as much or more than sufficient to pay the cheek is presumptively of some value in the hands of the person in whose favor it is drawn." The Supreme Court says that it has long been an established rule of the courts that without proof of the value of stolen property there can be no conviction for larceny, that it is essential to prove the value of the property alleged to have been stolen, in order to determine the grade of the offense and the penalty to be imposed, and that, in the absence of any evidence upon the subject of such value, the court or jury could not indulge in presumptions to supply 'the omission. The goods need not be proved to be of the value charged in the indictment, but it must be shown that they are of some value. in our -opinion," continues the court, further along, "in the giving of this instruction the court usurped the functions of the jury and took away from them the question of value, which was their province alone to determne. In criminal cases the jury are the exclusive judges of the facts proven and of all inferences to be drawn therefrom. The court held that on the trial of the cause it became a material inestion whether the check in eontro-ver-sey, payable to order out of the pos session of the payee, and without his indorsement thereon, was of any value. The erroneous instruction, in effect, told tlie jury to ignore the testimony of the witnesses as to value, for the eason already indicated, that a value was to be presumed.

Logansport Journal: After Captain Swigart's retirement from the Congressional race it was proper that Cass county give Charlie Landis its support. He was a Cass count}* boy and is now resident of an adjacent county. His record is good and his ability unquestioned. The previous contest gave to Judge Johnston five votes more than it required to nominate, and there was no reason why Cass county should not lay aside al! differences and give Mr. Landis a solid delegation. It was good politics to do it. Mr. Landis represented the young .men and his sup porters were styled "the kids." It is the enthusiasm and earnestness of the kids" that deserves recognition. They got it yesterday, are feeling pretty well, thank you, and will be heard from this spring and fall

Necessary to a choice, u:i. The Johnston men claim more than this which the Landis men do not concede. This is not material now as it appears on the face of the returns that lohnston has enough without the others claimed. Lake and I'orter have not yet selected delegates but these :ounticn have been conceded to Johnston from the start.
The work remaining will be missionary work among the delegates selected and it would seem that Johnston would be able to get as many Lnndis delegates as Landis could Johnston delegates so that the situation will be practically unchanged.
Considering the situation, Cass county did quite the proper thing and as the result, as far as Cass county is concerned, is practically a victory for both sides the utmost good feeling is bound to result from it.
The convention will be held at Hammond May '-'I.
