'IHL LIOHERTY CASE.
All Hit T.jatmiony Submitted to the furee Circuit Uourt.
Tln» attorneys and witnensea in the cane uf Hurley ,V ('lodfelter against, Sarah O. Dolierty, ot ul, returned from Hockvilie last night, the evidence in the case all being in. 'I lie arguments will not take place for some time yet. The ease was interesting and in some features quite sensational. Brush ,t Snyder represented the plaintiffs and Crane A- Anderson and IIanna Ilanna the defendants. The suit was for 821,'200, attorneys fees, which the plaintiffs claimed was due them for prosecuting and winning two suits against Messrs. 1 iobb .V Street, of .loplin, Mo., whereby the defendants in the present suit came into possession or 1011 acres of lead bearing land, worth SI,01)0 an acre.
I he plnintitl's testimony went to prove that no contract had existed between them and the Dohertys as to what should be paid for le^al services. They accordingly asked for SI,000 for collecting royalties, 8200 for minor services, and $20,000 as being 20 per cent, of the value of the property won for the Dohertys in the two sr.its. They claimed much time and labor had been expended by them and introduced 1'. S. Kennedy. Jud go Thomas and .lames Sellar to prove that 20 per cent, was not too much to ask.
The testimony of the defense went to prove that before the plaintiffs had undertaken the cases that a contract had been made which explicitly stated that they should receive 82,000 if they won both suits and 81,000 if they won one. 1'urther that the servites of Missouri attorneys had won the suits. That after the trials in Missouri that M. K.
Clodfelter rushed to Cincinnati where Sarah (J. Dolierty was visiting her grand daughter, Mrs. Tom 15. Noble, ami demanded 80,000 or. a deed to 20 acres of the land, that he conspired with Noble to bulldo/.e the old ladv into giving the deed, stating that if she did not be would get the cases reversed and have Mat anil Marth sent to prison.
I wo letters from Noble to the Dohertys were introduced. One written just fore Clodfelter's visit cursed in a most outrageous manner and concluded by advising Mat to tell "old Marks (meaning Clodfelter to go to hell where su mpositor's belong." The second was written after Clodfelter's visit and the formation of the alleged conspiracy The letter lauded Clodfelter to the skies, advised deeding him the 20 acres and concluded by saving "Old Marks is a plumb dandy." It had been claimed by the plaintiffs that Mrs. Dohertv deeded property in Crawfordsville to defraud them of their fees. It was
proved by 1?. Hauna that he had made the deeds from a copy of one made by Clodfelter a year before when he had advised Mrs. Dohertv to deed her property to her grandchildren in order to beat the creditors or Mat, and Marsh in case of her death. The copy was necessitated by an error in Clodfelter's description of the property
Extravagant Praise.
The Indianapolis -hnmini in nr extended and eulogistic account of the performance of the Philharmonic Club says:,
The New York Philharmonic Club gave an unusually fine concert last night at Y.M.C.A hall, before an exceedingly slim audience. Seldom has a programme so delightfully arranged ueen given in this city, and' the artists presenting it are unsurpassed. The six members play so harmoniously that the fact that there are six instruments is scarcely realized, so perfect is their unison. The enthusiasm expressed by the few present was such that if the number had been greater the applause would have been deafening. The compositions given by the club were varied and admirably arranged. Those who love good music and did not hear the concert missed a treat not likely to be duplicated this nor any other' season unless the club should resturn. li is a pity that the new organization, the Young Woman's Christian Association, under whose auspices and for whose benefit tho concert was given, should bo out of pocket through lack of patronage for so excellent an entertainment.
Improvements in a Saw Mill, Tho Crawfordsville Lumber Company is making extensive improvements at its mill. Among other things a new steel roof is being placed over tho building and tho circular saw is being displaced by a band saw. The band saw is now being used by all "the larger mills of the country as it possessed many advantages over the old circular saw. It is as much superior as the electric cars are over tho horse cars on street railroads. Besides an increased speed in sawing a great saving effected. It is estimated that in sawing 10,000 feet of lumber 1,000 feet can bo saved, the kearf being less and not so much of the log going into saw dust. The Crawfordsville Lumber Company is one of oui thriving industries and Tun Jont.vu, notes with pleasure the improvements in progress.

We3 Foster Laid Out,
John Sullivan was fined Inst evening for inflicting a beastly threshing upi Wesley Foster. It appears that Wesley entered the Market street joint where Sullivan presides as bar keeper anil called for whisky. Mr. Sullivan ic sisted that he take beer instead, on the ground, doubtless, that the whisky was too strong, the new keg .t yet having been tempered with hydrant water. When Wes refused Sullivan threw the beer away and proceeded to make mince meat of him. It was a delightful little episode and rellects great credit on the pugilistic power of the accomplished
Mr. Sullivan.
