MUST MAK£ IT OVER,
The Bond Presented by John 0. Hutton Declared to be Invalid. Yesterday the Commissioners mot in special session to examine and approve or reject the bond for S350,000 presented by John C. Hutton, Treasurerelect of the countv. The bond was duly presented and on examination it was found that the nnmo of one of the signers had been erased and another substituted. Sntu Con 1 tor, of Mnco vicinity, had withdrawn from tho bond after others had signed it. Tho question was brought- up at once whether or not tho erasure would not vitiate the instrument so far as all the names below it wore concerned. Different opinions were held by tho various attorneys as to the legality of the bond. County Attorney Whittington asked time to look up the authorities on the ense nnd was granted until 10 o'clock to-day. At the appointed hour he came prepared to decide tho case. He reported that there were two points in tho bond which render it invalid. One of which was the erasure of tho name of the signer after other names had been appended, a fact which should suit ever be brought, could bo pleaded as an excuse for non payment on the part of the sureties as that not being the bond they had signed.
The other point was that the acknowledgment of tho signatures to tho instrument were taken wrongfully. The signers have simply come before tho Board and acknowledged that they had signed the same, whereas the Statute provides that the acknowledgment shall be taken before some officer empowered by lnw to take acknowledgments to be voted in law. When this was announced the Board made an order that Mr. Hutton should at once proceed to fill a newbond and fill it according to the letter of the law. The time for him to take the office to which he was elected is Sept 2. This gives him only three weeks to till a new bond. This will be time enough in case he only has to arrange with those whose names now stand on the bond but in case some draw off, it will take considerable work. It is a most unfortunate affair and it is to be hoped that it will not cause serious delay'.

Js'nw Boss, Aug. 11, 1891.—Every train brings something in for tho fair. There are several competitors from Crnwfordsville in the art and fancy work department.
The Haw Creek band will furnish the music for the fair. They arrived this morning.
The merry-go-nronnd is in the ground and its music will bo heard. Never before was there so much stock upon the ground at one time ns at present.
Tho race this evening was a great success 11s it was a mixed one. Tho floral hall is being rapidly filled with fine work.
Tuylor Boll, of Ladoga, is digging another well. Tho grandest feature will bo the free for all trot as Lost Bay, Hoosior Boy, .Toe H, Chance, Western Boy, Tommy Lee and others will bo in it.
There was 19 entries in wheat within an hour this morning. The hog pins are all full and more are building. 11. L. Bratton lias 19 of his fine herd. He took V2 to the North Salem fair and got seven premiums—5 reds and 2 blue. Ho will have a salo October 7 at tho fair grounds hero.

A "Ginuine Diabolical Toimo" in the Mayor's Court. This morning Patrick Brennan 1 arraigned before the Mayor for disorderly conduct and being in a stato of intoxication in a public place. Pat pleaded not guilty, and a trial was had, which reminded one of the famous trial in which "Cousin Sally Dillard" figured ah a horoino. I'at was as full as tho traditional "biled owl," and with tho gravest face declared that ho had not touched tho stuff which inebriates for some IS months, and to bo accused scandalized hint .beyond measure. The
Mayor undertook to catechize tho old man, and was met with tho retort, 'Yez diabolical ould bald-headed fool dry up yorself." Much fun was created until tho patience of tho Mayor being exhausted he ordered tho Marshal to jail him. It was not done but Pat was lined and costed $8.40.

A Gas Well.
A gas woll is to bo sunk at Piko's Crossing, Boono county, on tho route of the proposed gas line. If tho fluid is found it will bo a great find for the company. Tho casing is being delivered there now.
THE SMOKE STACK INSURED.
Another fire Hydrant Wantod -A New Minuto Man Appointed. Counoilman Vauarsdal was absent from the Council meeting last evening. Everybody else was present.
A petition was read and referred to the proper committee, asking that a (ire hydrant bo established at tho west end of Market street. Tho petition stated that for distance of two blocks there was no water main and owing to the groat amount of travel along there the residents were greatly annoyed with dust. It was signed by about thirty property ownors.
Tho Police Board, as usual, had no report. Nothing was said about the Sunday, a few weeks ago when tho saloons were closed.
Tho Fire Board reported that Albeit McNeely had been selected as minuteman to Bucceed Bob Irwin who is to tuovo to Ladoga. The board also reported that the fire engine had been returned from Fowler and was now in engine house No. 2. Tho Treasurer also received from tho city of Fowler tho sum or $25.
The Board of Public Improvements as usual brought up that famous dirty alley back of Green street near Market. Like Bauquo's ghost this alley will not down. It is filthy all the time and yet it is impossible to drain it unless through the ravine of MisssJnnio Jones. This will never do as the water for tho standpipe which is now being piped from there is likely to bo contaminated. As Mr. Reynolds said the only way out is to build a sower and at the present state of finances that is out of tho question. A sewer would cost from $2,000 to S3,000. The Board also rejwrted that the tile at the corner of Green and Market street was insufficient and the city was threatened with a damago suit unless it was fixed. Very little street improvement has been done, the most extensive being on Lafayette avenue.
Dr. Jones reported that tho now smoke stack of the electric light works had been insured through J. L. Shrum against cyclones and storms for the amount of $4,000 extending over a period of three years. The cost of the policy was S31.20.
Manoger Sheetz of the Water & Light Company, reported the completion of the water main extension on west Wabash avenuo and that tho hydrant rental began August 1.

Mr. Smith defended the Commission ers and said they would probably havo a report nt the next Council mooting. For the benefit of the commissioners Tup. successor, James Wright has been sick in bed for weeks, nnd Isaac Vance was for some time laid up with a broken arm. This leaves only B. R. Russell, who is not sufficient to make a quorum.
A suggestion to reduce tho peddlors' license from S3 a day to 81.50 was discarded as being inimical to tho business interests of the city.
Ed Townsloy's frog pond came up once more nnd it was found that tho ordinance providing for its drainage had novor been published. It was hunted up and ordered printod.
Mayor Carr suggested that an ordinance providing severe penalties for damaging tho poles, wiros and lamps of tho electric light plants. I
Tho City Engineer asked if biddors on tho east Wabash avenuo improvement and other improvements would havo to take tho bonds for tho deferred payments and was informed thnt under the strict constructions of the Barrett law thoy would. This will probably make some difference in tho bids, probably 30 per cent., nnd thoso property owners who expect to pay cash for their improvements had lottor bid the work in themselves.
Councilman Reynolds informed tho Council thnt if the improvement on oast Wabash nvonue proved to be ns bountiful nnd substantial as is anticipated, tho citizens of Main stroot from Grant avenuo west would petition for a similar improvement.

Col. W. C. Wilson is still nlive this afternoon, though unconscious. His physician says he exhibits moBt wonderful vitality and may last a week or ten days yot.—Lafayette Call. •Tho room occupied by James Lnymon ns a cigar store on Main street is undergoing a course of ropairs. It is to have a new floor, new wall paper and refreshed generally by paint and putty, —Janitor Boraker is busily engaged in whitewashing tho corridors in the basement of the court house. It is quite an improvement as the walls were very dnrk, and the way extremely gloomy. —Mr nnd Mrs. W. H. Using three as a multiple, which is a lower multiple than Is used in most cities, this shows a population of 290,475. Last year's directory contained 02,400 names and the population then was estimated at 277,400.
