THE TAXING POWER OF THE STATE. IVo decisions rendered last week by the Supreme Court of the Unitod States are of great interest, because theT bear upon the question of the relation of inter-state commerce to the taxing power of a state. One of these was on the case of Massachusetts against the Western Union Telegraph Company for non-payment of arrears of taxes. Massachusetts had levied upon the lines of the company within the State, assessing them at a valuation bearing the same proportion to the whole amount of stock of the Western Union that their mileage bears to the whole extent of its telegraph lines. The company refused to pay on the grounds, mainly: First, that the Massachusetts assessment was in*]uilabl*. inasnmch as it ignored the fact that the total value of Western Union property included certain exceedingly valuable real estate in "ew York City and elsewhere and second, that it possessed a Federal franchise under which it was doing an inter-state business. The Supreme Court decided in favor of the State. The second case was in a great measure analogous to the other. Pennsylvania undertook to levy takes upon the cars of the Pullman company running over the roads of the State, the valuation being obtained by a computation similar to that adopted by the Massachusetts officials in estimating the value of the telegraph lines,

The Company's defense was that its pro|M?rty could only be taxed in Illinois, where it is incorporated and where its works are, and that to tix its cars running through other states is to tax inter-state commerce, which it is claimed to lie unconstitutional. The court, the contrary, held that there is nothing the Constitution or laws of the United States to prevent a State from taxing cars or other personal property in regular use within its borders.

THROUGH Republican legislation New York the tax levy for .State purposes has been reduced from 2.34 mills to 1.3-iJ mills. This was done by taxing corporations. In Indiana through Democratic legislation the levy has been increased from 2S cents to 34 cents, in eluding schools. Instead of increasing the tax on corporations it was reduced from 75 to 100 per cent. The Democratic Legislature preferred that the burden should le imposed on the lands.

Our citizens were grieved to hear Sunday evening of the death of W. F. Hhoads of erysipelas arter a brief illness at the age of 01 years. Mr. lihoads was one of the most prominent citizens and an elder in the Presbyterian church. The funeral services were conducted at 2 p. in. Tuesday at the Presbyterian church.

INDIANAPOLIS, Ind., May 19.— Esteila Morris, a colored girl, 16 years of age, was arrested Sunday on a charge of poisoning with intent to kill. The victims are her parents, Allen and Roxie Morris, three brothers, Levi, Solomon and Clayburn and a boarder named Rector. They partook heartily of boiled meat and greens prepared Monday by the girl, who it was noticed refused to eat of the preparation. They were all soon seized with vomiting and suffered intensely, but all recovered, though the mother had a narrow escape. The girl admits having put poison in the meat and greens, and says •he was told to do so by a man named Silas Esley, in order to kill the boarder, who, she says, was trying to ruin her. The intended victim was taken ill on returning from summoning a doctor, and although 76 years of age was one of the first to recover. The girl has been wild and hard to manage hitherto, and her parents say the law may take its course.

He Was Fond of Traveling. PEBU, Ind., May 19. —Tha mystery anrrounding the disappearance of 13-year-old Willie Affelder, who was last seen in December, 1SS9, and of whom nothing had been heard since, notwithstanding the most strenuous efforts, was cleared up Sunday by his return from Chicago, where his father found him. The boy's story is a most romantic one. After leaving here he went to Chicago, where he worked three weeks in a police station, notwithstanding the fact that the newspapers teemed with descriptions of him and detectives were on the lookout From there he went to St

Louis, remaining four months. Thence he went to Omaha, Des Moines and Texarkana, and then returned to Chicago where he worked on a steamer between Chicago and Buffalo. From there he went to California and back again to Chicago, where, through business relations, he was discovered and Mr. Affelder advised of his whereabouts. The boy is hardy and his reason for not returning sooner was that he liked to travel.

Sennatlonal Elopement.

COLUMBUS, Ind., May

19.—One

most sensational elopements that ever took place in this part of the state occurred here Saturday morning. When the south-bound train on the Pennsylvania departed frOm the station it carried Lee Hudson, who has twice been confined within the state insane hospital, and Dora Shields. Miss Shields is one of the most beautiful women in this part of the state, and but 18 years of age. Hudson is a practical druggist and but 24 years old. The parents of the young people are friends, but greatly distressed over their marriage under the circumstances.

Fatal Wreck-An Engineer Killed. HUXTINQTOS, Ind., May 19.—At 1 o'clock a. m., Sunday, passenger train No. 4 on the Chicago & Atlantic railway came into a front collision with a freight train at this place. Both engines are almost total wrecks. The passengers escaped serious Injury, but Engineer Cal Lyons, of the passenger train, was killed and David Griffith, fireman of the freight engine, was seriously hurt The airbrake of the passenger train failed to work, and it was discovered that somebody had tampered with it. Two tramps stealing a ride were suspected of the deed and were arrested.

thy Gates, an ll-year-old colored boy, was shot Sunday nipht by a playmate named Lewis Johnson, also colored. They wore playing Huffalo Bill with a revolver which Johnson fired at an imaginary Indian. The bullet entered Gates' forehead and made what is probably a fatal wound.

The May Festival.

Even a casual glance at the published programme shows that it has been prepared by a master hand. Theodore Thomas has become an adept in arrangeing a programme, both creditable to himself af a musician of high order and popular interest. Praise, music, overture, songs and instrumental concertos and selections from operas and great popular symphonies follow each other in such admirable arrangement as will be sure to please even a most varied audience. Introduced in the first parte of the programmes are the more pretentious workB, while the second are largely made up of more popular music. Not only is the variety of the music unusual, but an unusual numlwr of the great masters are represented by works which are believed to be the favorites of the respective composers. This is instanced by the concerto for riolin, by Beethoven, "TlieMauzoni "Requiem." of Verdi the "Antony and Cleopatra" overature. by Rubenstein Mozart's minor symphony, and Mendelssohn's "Hymn of Praise."
