Last night Frank Raredon, whose filthy den it will bo remembered was brokon up last summer and his children sent to tho Orphan's Home, went to Scott Steele's where his wife works and commanded lier to leave with him. MBS. WHITEHEAD'S CONFESSION WONT GO
is
AlOlear Out Decision from tbe Bench Which Boattura Dismay in the Banks of Ouriosity-Seekers,
W. F. PKTTIT.
(Hoforo lie had his beard trimmed.)
YESTERDAY AFTERNOON. Wilson took up the case of tho SUtu vs. Williams, 568 in tho 47 Indiana liepoits and cited from it. Judge 1) ividson thou inadoaddilionil objections, thai io conspiracy is admissible in evidence unless it is a oo^piraoy to do tho act charged in tho i::diotment, no word of a -conspirator is admissible when tho quest ou iu ditou»tii ~n involves onlv ooll .leral matter. W.lsau thou
quoted
from cases in tho 07t.li Iowa aud 4.0th Oino reports, cud grew vuost demonstrative iu his plea abusing Pettit liko a pirate at every step. The decision in the 57th Iowa, was to tho effect that it was not nouossaty to allege conspiracy but it is admissible to prove it in order to establish tho prinoip.il foot. It was to iho same clfect in the Ohio report. Tho bard case from the 10'Jth Indkna repoits was then cited. Tho 17th Kansas reports, page 296, and the 30th A1 bama reports, page C37, were also quoted. During the last oitation Wilson refered to Mrs. Whitehead being ten years older than Pottit aud whispering first in one ear and then in the other. He turned here and pointed at Petrit, who laughed in his face. Pettit, his attorneys and everyone in the room roared when the Colonel sp^ko of Pettit's morely waiting until the storm blew over oeforo ho "married the girl on Shawnee." Wilson referred to a letter of Mrs. Shields to Mrs. Whitehead being found iu Pettit's hands yesterday as evidenoe that they were in a conspiracy togother. Haywood then ciied two cases to prove that whatever unfolds or explains a oonspiraoy is admissible, they wore fonud in the 16 :h Iu liana, page 205, and in the 71
Indiana, page 85.
Kumlor then arose and said if it were not for the gravity of the case the citations and efforts offered by tho State would excite his laughter and contempt. He said that three times before had Haywcod lost this same question. The ca.se in the indictment is not for oonspiraoy bnt murder. He denies the right of the oourt to admit evidenoe of oonspiraoy when there is an indiotment for murder alone. See section 58 of the Rill of Rights of Indiana. Pettit is tho defendant for murder, aud the State is trying to establish a continuing oonspiraoy to marry and to punish the defendant uuder a charge of murder for a oonspiraoy to many. Can there te any suoh thing us a oonspiraoy to marry. There can bo no conspiracy in Indiana except to oommit a felony. Again the evidence is incompetent because the statement ol the witness is a mere narrative of a past event. Kumler here grow very comical and excited laughter on tho proposition that the State were trying to convict a mau of murdor by proving a oonspiraoy to marry. Why on that proposition a man couid IJO punished twic«, onoe for oonspiraoy and once for murder. Mr. Kum'erand Haywood passed bitter words. Haywood accusing Kumler of misquoting his authority and Kumler olosed by saying, "Yes, Your Honor, I'm here to laugh, yes laugh at the torn foolery of the State." Arthur Stuart then aroso to add a few remarks. He said in subbtanco, one of Col. Wilson's proposi tions was that there had been flight and und concealment. Suoh is not the case. Pettit has never been guilty of secresy, oven with Mrs. Whitehead. Ha oited several of the oooasions iu which the State had claimed thuro hod been criminal intercourse between the two, and protested th'it in every case hud a third party been proved present. He said the State could not ask the jury to infer the guilt, if they could likewise infer innocence, made eloquent by the letter of little Adine which said Mrs. Pettit wautod hor friend Mrs. Whitehead present during her sickness. "Tne words of that poor little 6 year old girl far oil under hostile influences are conclusive." The aot of a oo-oonspirator oau't bo proved uuless it is apart of the res gestae or in pursuance of a oommon design. Ho then oited the case of Cortez vs the State in the Southwestern Reporter. In this ease the oourt held to the proposition last laid down. He also oitod from tne 42ud Indiana, pug 46. He olosed and then Mr. Hiywood arose aud said that the bluff and bluster might work with the populace, but ho did not believe it would with tho court. He said tho conspiracy was to murder and get married, not to marry ulono. Tho fruit of this oonspiraoy is the crime in hand und at the marriage
