But when ho sent down for them yosterday ho learned that the entire orobard had boon stripped of it» fruit by thieves. Not over three bushels were left. Tho bold robbers made their trips ou Saturday, Sunday uud Mouday nights, respectively, Mr. Bourn probably thinking each time thoy would uot t.o rush enough to return. Strangers were iu town yesterday with eighteen bubLels of pcaches for fnle, but it was impossible to tell whether thoy wore tho thieves. Complaint is being mado oo, of peaoh thieves in dillerent parts of tho oity. Probably most of them a:o boys, but a few of tlie.m should bo caugl.t uud mado to serve as oxamples.

THE MRS. WHITEHEAD AN END.
CASE AT
Judge Rabb Sustains a Motion to Nol Pros at Lafayette this Morning.
Special to tl 'ouruul: LAFAYETTE, lnd., September 3.—On tho assembling of the Circuit Court this morning Prosecutor George F. Hay
wood filed motion to nol pros tho ooso as to ElmaC. Whitehead ou account of tho absenoe of certain testimony. Judge Rabb sustained the motion mode thus ending the oaso against Mrs. Whitehead on this indictmout.
The above telegram was shown Mr. Pottit at the jail shortly before noon today as ho sat in his room among his books and ilowors. Ho read it through and handod it back with a suiilo which might 1)0 interpreted any way. He hud nothing to say uud if the news disturbed him he failed to show it in the least. It was tho 'irst he had hoard ot tho disrn ssal.but it was plain that ho was not suprissd at tho news.
This practically ends mutters now until tho Pottit cusu comes up iu this court October 8th. 'I ho expected motion for oontinuunce seems not to have been mado and some speculation has boon indulged in on this account. It is al-o a surprise to some that the dofonso mado no effort to fight tho motion to nol pros, since thoy seem to think that tho trying of tho Whitehead oaso tirst would have been so fuvorablo to their cause.
Thoso interested in tho defenso state that the action of the prosecution was the result of fear for the outoomo of tho ease. Said one: "Thoy havo no case against Mrs. Whitehead that could loul to a conviction, and suuli an issue must of course materially weaken tho civse against Pottit, us it would destroy the charge of conspiracy upon which thoy have laid so inuoh strtss. Even il the ouse were strong against her it would be moet difficult to convict her ou account of her sex, family u:,d previous good churacter. The prosecution knows just how its caso stands, aud not only that public sentimout would bo turned in Pettit's favor by Mrs. Whitehead's acquittal, but that they would have to lay bare their whole lino of attack against him in her trial, and thus give liis lawyers an opportunity of shattering their evidence by rebuttal. It shows thoy havo a weak oaso against both of them, and it was a tricky move to avoid wha I consider a fair light.
GAS AT NEW MARKET.
0. W. Kennedy Strikes a I'ino Flow of Gas at Seventy-three Feet. Sprelu! to The Journal.
NEW MAIIKET, Sept. 3.—C. W. Kennedy, while drilling a well hero yosterday, struck a fine flow cf gas at a depth of 73 feet. It was tested and burned brightly. It will bo piped to the top of tho ground und t. sted thoroughly ot at 7:30 this evening. Thoro is great excitement amonif the citizens.
Charles \V. Kennedy was in the city to day obtaining two iuoh pipe aud faucet to test the pressure of his gas well this evening. He states that ho drilled through solid rock beforo the gas came, and thai it burned with long brilliant blaze. Ho returned home on the local freight ut 1'2 p. m. Tho geuerul impression here is that pocket of marsh gas has been struck, but if mituiol gas has been its valuo to this city cannot be overestimated.]
