In the Southern and Southwestern States the commission bus had reason to think tho carriers were moving more slowly in bringing their tariffs into conformity with flu general statutory law than in other sections. An investigation has been, ordered on Dec. 18. . The report then taken up the subject oi the effect of the Inter-State Commt rte law upon common carriers, and says that although some railroad mnnaeors havo de clared it to have hod a damaging eifoct the commission is possessed of no evidence showing that the general re-uit has heem otherwise than beneficial. Bailroad busi ness has suffered in the past year not because of the Inter -Stato Commerce act, but; owing to striRes, new parallel lines, and rate wars, with reference to the rate war;, in the Forth wept and among the trunk lines during the year the repc-rt fay: As is commonly the case in rate wars. the trunk lines' difficulties resulted from, suspicions on tha pat of carriers respectively that their competitors were cutting' the open rates, and reductions were mode to ra -over freight which parties to tho agreement claimed was their due, but which they were not totting- because of tho secret catting by others. Efforts of thu commission to obtain evidence of the prac tices suspected have been wholly ineffectual. and the war of rates proceeds without pos sibility of external authority interposing to bring it to an end. The legal right of tho carriers to reduce their general scale 01! rates to any extent under the law as it now stands is believed to be unquestionable; they have done so, and whether with any ultimate benefit to themselves is at leastvery questionable. Every case of ratn war may be regarded as one of this character. Present profits are sacrificed on n calculation that by crippling a rival ait forging 1 an agreement or compromise ou some matter of contention the loss will in time be more than made up. In the majority of such cases the losses exceed tins gains... The report says that the tendency among railroads seems likely to be in the direction of consolidation as the only monns to prevent rate wa:-, now ttt pcoling is forbidden, and adds: "Bat anything equivalent to ihe creation of what is now technically dominated as a, trust could hardly be supposed possible, even if the parties wore at liberty to form it at pleasure. If the parties could come into harmony on, the subject of an arrangement of the sort would be so powerful in its control over tho business of the country, and so susceptible to uses for nvschievous purposes, that public policy could not for a moment sanction it, at least unless by statutu it were held to clo$ legal rostrainfcj and under public control:'- liike arrangements to other lines of business are 3UlHciently threatening to the public intorsfit, and the most ardent advocate of the con centration of railroad authority cannot reasonably expect that anything of tbe sort to control the transportation of the, country will be provided for by legislation. Lacking concentration of authority, railroads can do much toward better relations with the public, and "do better service, by first .establishing better relations among them wives." , While the commission is not at this time prepared to recommoud general legislation toward the establishment and promotion of relations between the carriers that shall bols ter subserve the public interest than there which are now common it must, nevertbolesr, look forward to the possibility of something f that nature becoming at some time imperative unless a great improvement in the existing condltione'is voluntarily inaugurated.' The report next considers the subject of the effect of the law upon cities, sUnving that tho act has income cases lonefitUd consuming interior" cities and injudiciously affected distributing points formerly favored in rates. The commission believo uniformity in classification, as fast as possible, ' without serious mischief, is desirable. The requirement of annual returns from carriers by water has not been overlooked, and the commission renews recommendations made to its preceding report The commission believes notice of intention to reduce any rato ought to be published not less than three days before tho reduction, and that the penal provisions against fii'e billing, wrong classification, etc, should embrace also the owner of tho property or any party acting for the ownor or consignor of propurty who shall be p$P to any such unlawful conduct The comsiiission suggests that tha question thus raised be settled by express provision.
