Cartwright wins first case; jury awards $5 in damages

INDIANAPOLIS (AP) Fired Hoosier Lottery official Mary L. Cartwright says she feels vindicated after a federal court jury believed her and her children when they finally got the chance to tell their story. A jury found in favor of the Cartwright family Thursday night in their lawsuit claiming a state police sergeant violated their rights by entering their apartment during an investigation of Cartwright’s sexual harassment allegations against former Lottery Director Jack E Crawford. THE JURY OF four men and two women made only a token award of damages tered little to Cartwright, who said her reputation was more valuable. “I’m very happy. I’m very pleased. Very, very, pleased,” said Cartwright after the four-day trial. “This has been a long, long, long and very hard struggle.” Cartwright broke into a broad smile and hugged her son, Terrence Bailey, and daughter, Brandee Cartwright, as the verdicts were read. CARTWRIGHT said her major difficulty the last 20 months has been overcoming the “image they portrayed of me” after she was fired by Gov. Evan Bayh’s aides

Head of Kinsey Institute shares ‘hot’ data from survey of 111 students

BLOOMINGTON, Ind. (AP) College students have a lot of sex, so they need to be careful, the head of the Kinsey Institute for Sex Research says. “This data is hot off the computer, and it’s pretty hot data,” Director June Reinisch said. ACCORDING TO an institute study conducted last spring with 651 Indiana University students, 81 percent of male students and 75 percent of female students had had intercourse at some time in their lives, Reinisch said. The average age of first intercourse was 17 for both men and women, and the average length of sexual activity for the students was about four years. Reinisch, in her annual lecture to students Thursday, said the study showed, “If you’re in an exclusive relationship, you get more sex.” Also, students in exclusive relationships start having sex older and are less at risk of contracting sexually transmitted diseases, she said. who claimed she had lied about events surrounding Crawford’s resignation. “At least the public knows the entire story. In the past, only the selective parts came out,” he said. She also said she plans to move ahead with another lawsuit against Bayh aides and the lottery for what she claims was her unjust dismissal in January 1990. That suit is expected to go to trial next spring. AFTER DELIBERATING six hours, the U.S. District Court jury

with their sexual partners, and 10 percent live with their sexual partners, Reinisch said. Vaginal sex is not the only kind of sex that exists, she said. “Americans believe that intercourse is the only kind of sex that counts,” she said. Oral sex can be safer in several ways, she said. “Nobody’s ever gotten pregnant from oral sex, not that I know of.” Male homosexuals are not the only people who engage in anal sex, Reinisch said. The survey showed that one out of five heterosexual IU students has tried anal intercourse at least once. Her statistics show that about 50 percent of the male students and 36 percent of the female students have had sex with a person they had just met, and on average had engaged in two onenight stands last year. “One-night stands are really very risky,” she said. “These one-night stands happen less and less frequently as you grow older.”

found in favor of Cartwright and her two children on their charge that state police Sgt. Bernadette Stamper violated their right to privacy by entering their apartment without a warrant. Each was awarded Si damages on that count The jury also found in favor of Cartwright and her daughter on the count alleging Stamper trespassed. The two were each awarded SI on that count. The low damage awards don’t reflect the total possible loss for the state. Cartwright’s attorneys said they’H probably petition the court to have the losers pay Cartwright’s attorneys’ fees. Those fees could range from $70,000 to SIOO,OOO, said attorney Timothy L. Bookwaiter. STAMPER, 34, who has been with the state police 12 years, declined to comment after the verdicts were announced. Her attorney, Henry J. Price, said he was disappointed by the verdicts but heartened by the jury’s finding that the plaintiffs didn’t deserve any significant damages. However, he claimed the jury might have been misled by Bookwaiter’s argument earlier in the day that money wasn’t the main issue at the trial. “I think Mr. Bookwaiter was not

Hoosier family at center of latest revelation in Alzheimer’s research

WASHINGTON (AP) Researchers have isolated a mutated gene that may play a role in one form of Alzheimer’s disease by studying the genetic pattern of a family who suffered from the brain disease for generations. In a study published today in the journal Science, scientists at the Indiana University School of Medicine said they found an alteration in a single gene on chromosome 21 in an analysis of blood and tissue of 30 members of an Indiana family. JILL MURRELL, a co-author of the study, said Thursday the finding provides a genetic basis for a type of Alzheimer’s disease that starts at an early age, but a link between the gene and the disease, which occurs randomly after the age of 65, has not been established. Familial, or inherited, Alzheimer’s accounts for 15 to 20 percent of the 250,000 new American cases of the disease diagnosed annually. Murrell said only some of the inherited forms of

Politically weakened Kaifu will not seek re-election, party officials claim

TOKYO (AP) Facing crumbling support within his own party, Prime Minister Toshiki Kaifu decided today not to seek re-elec-tion after his current two-year term finishes at the end of this month, party officials said. Party leaders said Kaifu overstepped the bounds of his caretaker role. HIS DECISION came as the Parliament shot down his moves to reform the country’s scandal-ridden political system, and a day after the head of his party’s leading faction withdrew support for the prime minister. Kaifu’s move immediately threw Japan’s political world into turmoil with elections scheduled for a new president of the governing Liberal

candid when he said it wasn’t about money,” said Price. “It was about money attorney’s fees.” BOOKWALTER would not have been able to collect attorney’s fees from the opposing side if he had lost the case. Stamper’s attorneys’ fees which have totaled more than $337,000 have been paid by the Indiana Lottery Commission. During final arguments Thursday, Cartwright’s attorneys appealed to the jury to hand down a verdict that would enforce the constitutional prohibition against unreasonable searches and seizures. “WE ASK YOU IN this case to protect the right of each of us you, me, anyone to feel safe in our home,” said W. Van Barteau, another attorney for the Cartwright family. Stamper’s attorney argued that the sergeant’s fears for Cartwright’s safety justified the decision to enter the apartment and that the law prevents second-guessing of a police officer’s actions under such circumstances. “She decided that was her job at that point, what she had to do, what the circumstances demanded, to find out if Mary was all right,” said Price.

the ailment start at an early age. Alzheimer’s is a fatal disorder of the brain that involves the progressive death of brain cells. It is marked by the steady, irreversible erosion of memory and the ability to reason. Brain function eventually is destroyed, with fatal results. ONE OF THE prime markers of the disease is the deposit in the brain of a substance called amyloid. In the Indiana study, researchers found a mutation in the gene that leads to production of this substance. Dr. Gene Cohen, acting director of the government’s National Institute of Aging, said the Indiana finding was “very important” in the effort to diagnose and combat the disease. “It adds to an understanding of the cascade of events that go on in Alzheimer’s disease,” he said. “The more steps in this sequence that we can identify, the better are our opportunities to intervene at some point.” THE INDIANA researchers reported they found the mutation in

Speaker sets up panel to study school funding

INDIANAPOLIS (AP) A bipartisan legislative committee will study and evaluate methods of funding public education. “Based on the concerns expressed to me by other legislators, as well as teachers, parents and children from across the state, I believe the time has come for a comprehensive analysis of the way Indiana funds education,” Indiana House Speaker Michael K. Phillips said Thursday. PHILLIPS SAID he created the panel to survey major laws and regulations governing public schools and examine the types of adjustments that might be needed in current methods of education finance. That will include a look at alternatives to the school funding formula, a complicated method for distributing slate aid to local schools, he said. The state currently is facing a lawsuit from school corporations that claim the current funding formula is unfair. Phillips said the committee will also consider innovative approaches to education, including alternative curriculum, greater use of technology, longer school year, school choice programs and pre-school programs. a gene that causes the body to make amyloid precursor protein. This substance is an early step in forming amyloid, a prominent feature of Alzheimer’s disease. “Affected members of this family show clinical onset of the disease with short-term memory problems in their 405,” the study said. “Other cognitive difficulties develop as the disease gradually progresses. Disease duration is typically seven years.” Murrell said the investigators found that in the American history of the family, the disease appeared in the father in the first generation. She said he died at the age of 57. IN THE SECOND generation, three of nine children died of the disease. All three developed symptoms of the disease in mid-life and died at ages 49,48 and 53. Tissue samples from those patients had been saved and Murrell said a genetic analysis found the amyloid precursor protein mutation in each one. An analysis of samples from the five surviving siblings, however, showed no muta-

The shift in Japan’s top leadership was unlikely to have a major effect on government policies or relations with Japan’s ally, the United States, since the Liberal Democrats have governed the country with conservative policies since 1955. President Bush is scheduled to visit next month. KAIFU CONSISTENTLY received high ratings in public opinion polls, but public opinion usually is not the determining factor in selecting a Liberal Democratic president because the party faces no credible opposition. Japanese media reported that Kaifu gave up on a second term when his support within the party evaporated after he threatened to dissolve Parliament over its scrapping of his pet domestic project, reform of Japan’s scandal-ridden political system.

chaired by House Ways and Means Chairman B. Patrick Bauer, D-South Bend, will be expected to finish its work in time to forward its recommendations to the 1993 session of the General Assembly. The panel will begin work in November. Other members of the committee haven’t been appointed. Phillips said the committee will invite participation from teachers unions, school groups and business groups interested in improving Hoosier schools.

tion. In the third generation, said Murrell, the mutation has been found in a 44-year-old man who already has developed Alzheimer’s dementia. She said samples from the fourth and youngest generation have been taken, but she declined to give the results. MURRELL SAID isolating the gene mutation does not mean it is the sole cause of Alzheimer’s because the disease also may involve other genes. Investigators now are attempting to put this mutation into laboratory rats. This could lead to establishing a model of familial Alzheimer’s in rats, enabling researchers to test drugs that could slow or block development of the disease, said Murrell. Other researchers in the study were Martin Farlow, Bernardino Ghetti and Merrill D. Benson. Science, which published the study, is the journal of the American Association for the Advancement of Science.

Many lawmakers from his own parly opposed the plan, which could have eliminated some of their seats. '■ KAIFU REITERATED fiis threat to dissolve Parliament today when efforts to establish a council to come up with a new political reform package faltered. The threats appeared to have been made without the approval of party elders who were the political force behind Kaifu. Kaifu is from the smallest of the party’s five groups, the Komoto faction. The factions, which act as miniature parties, raise political funds for members and secure top jobs for them in government. The Takeshita faction plucked Kaifu from obscurity two years ago to become prime minister because' of his “Mr. Clean” image.
