The Crawford affair: Bayh is bashed for management of first real crisis
INDIANAPOLIS (AP) Gov. Evan Bayh, popular with the public and usually able to slip the jabs from his opponents, took the hard hits of political and media criticism for his handling of the forced resignation of Lottery Director Jack E Crawford. Mannweiler of Indianapolis, one of the Democratic governor’s most persistent critics. “I think it’s been sort of a travesty for the state of Indiana.” Bayh and Moreau caution against reading too much into the incident, which Bayh called “not your run-of-the mill government problem.” Instead, they argue, the case of Crawford’s alleged harassment of lottery human services director Mary L. Cartwright raised unusual legal questions and required moral choices that transcended the normal political considerations of gubernatorial decision-making. “THE FIRST RULE OF damage control in politics and I’ve been at this a long time is to get out all of the information as quickly as possible,” said Moreau, a one-time aide to Bayh’s father, former Sen. Birch E. Bayh. “This was a unique situation. It had to be handled differently. You had to break the rule.” The nature of Cartwright’s allegations, her desire to remain out of public view and the Bayh staff’s wish to protect her and Crawford’s family dictated discretion and caution, said Moreau. THAT’S WHY THE governor, who had campaigned on a platform of openness in government, declined initially to give details of why Crawford quit. “If the governor had announced the whole story Monday, it would have been a breach of our commitment to Mary Cartwright and would have subjected Ann Crawford (Crawford’s wife) and her two boys to the humiliation they now feel,” said Moreau. “More importantly, it would have been the governor of Indiana who created the situation.” On Thursday, after many details of the incident had been ferreted out by reporters, Bayh released a statement, approved by Cartwright, detailing the allegations. In a tearful confession, Crawford later admitted having a long-running, ex-tra-marital affair with Cartwright but vigorously denied harassing her. “I DID MY VERY best to keep them from being dragged through the mud in a public way,” said Bayh. “I am just sorry it had to come to this.” The Bayh administration also faced questions about how it handled the investigation of Crawford. Moreau first received information from Cartwright on Dec. 3 and got more detailed information from her on Dec. 5. The governor wasn’t told of the potential problem until Dec. 8 and when the Dec. 10 meeting was called to confront Crawford with the allegations, the governor didn’t attend. INDIANAPOLIS (AP) A plan to release $lO million to 916 Hoosier schools has gained the support of Gov. Evan Bayh. The schools to receive funds in the School Improvement Awards Program were named Saturday by Bayh and H. Dean Evans, superintendent of public instruction. THE AWARDS NOW await the approval of the State Budget Committee, which is to vote on the issue this week. “Slightly more than half of Indiana’s public schools have shown improvement from one year to the next in at least two areas of performance and will thus qualify for a cash award,” Bayh said at a news conference. The amount of the average award to a qualified school corporation is $37,030, the maximum is $855,037 and the minimum is $2,203. Some legislators on the budget panel have expressed concern about giving awards to 19 schools that were recently red-flagged for failing to pass an initial inspection under the state’s new performancebased accreditation system.

verify the allegations and give Cartwright time to weigh what she was doing. “I was concerned maybe this was an act of spontaneous rage,” said Moreau. He said having Bayh attend the meeting where Crawford was forced to resign “was never, ever discussed. I had been conducting the investigation. I was in the best position to respond to questions.” Mannweiler said the episode raises questions about Bayh’s involvement in day-to-day decisionmaking. “AT LEAST REAGAN was asleep and they didn’t want to wake him up,” said Mannweiler. “This time, the governor appeared not to be involved in decision-making.” Crawford, clearly embittered by the way Moreau treated him, said, “I think the governor was the victim of some bad advice.” But Moreau said as soon as Crawford acknowledged having an affair with an employee, he was going to be forced out because of the potential for a sexual harassment lawsuit and his poor judgment CRAWFORD SAID that when he has faced similar situations with employees, he has called them in to talk the problem through. Mannweiler, a labor lawyer, agreed that would be the normal way to handle a harassment claim. The use of the state police also raised questions. Bayh ordered police protection for Cartwright and some gubernatorial staffers, and Crawford later revealed he was followed and his wife questioned by police after he resigned. Moreau said he wanted to be

Institutions can use the awards for any educational purpose, but are banned by law from funding athletics, salaries or bonuses, said Evans. “It’s my hope that schools will establish broad-based advisory committees to determine how the money will be spent,” said Evans. Qualifying were 607 of 1,157 elementary schools, 130 of 263 middle and junior high schools, and 179 of 347 high schools. TO RECEIVE AN award, a school had to show improvement from one year to the next in at least two of four criteria: student attendance rate, English or language arts, mathematics, and average scores on the Indiana Statewide Testing and Educational Progress (ISTEP) exams. The program also allows schools to receive non-monetary awards for improvement in any one of the four criteria. A total of 351, 19.9 percent, of the eligible school gained those awards.

CRAWFORD, A former Lake County prosecutor, said Bayh’s staff should have known he would never do anything violent. “I don’t think the treatment was kind. I don’t think it was fair,” said Crawford. State police personnel were also upset when an internal inquiry was ordered to find out if any employees had been responsible for leaking information on police protection to an Indianapolis radio station. “Either there was something they’re still not telling, or they overreacted tenfold,” Mannweiler said of the governor’s staff. “It also raises questions about their Keystone Kops approach to using the state police for their own investigations. “ARE THEY USING the state police as a private police force or almost a palace guard for the governor’s office?” Mannweiler asked. The state police background check on Crawford also was questioned by Republicans, who earlier criticized Crawford’s choice by saying he was a political crony of the governor with no lottery experience. Bayh, who in June called Crawford a man of high integrity, said the check was the most extensive ever conducted. But he acknowledged it never turned up information on Crawford’s nine-year relationship with Cartwright “It came as a total surprise, a total surprise,” said Bayh.
Evans said the Department of Education will also recognize topperforming schools which may not be eligible for the awards. HE SAID certificates of achievement will be mailed to 152 schools which have met all the per-formance-based accreditation standards and have scored in die top 25 percent of all state schools in the four criteria. The school districts earmarked for more than SIOO,OOO are: Fort Wayne Community Schools, Bartholomew Consolidated Corp., New Albany-Floyd County Consolidated, School City of East Chicago, Gary Community Schools, Hammond City Schools, Anderson Community Corp., Metropolitan School District of Lawrence Township, Metropolitan District of Washington Township, Metropolitan District of Wayne Township, Indianapolis Public Schools, Monroe County Community School Corp., Portage Township Schools, South Bend Community Corp., Evansville-Van-derburgh Corp., and Vigo County Community School Corp.
