Following Jewish protests

County has nativity scene removed

: SOUTH BEND, Ind. (AP) ;For 39 years a nativity scene has decorated the lobby of the Countycity Building. But the creche no longer will be on view. ; It was removed Wednesday as ordered by St. Joseph County commissioners after a protest by the Jewish Federation of St. Joseph Valley. The Council of Catholic Women had been putting up a creche and a decorated tree at Christmas first in : front of the county courthouse and later at the lobby of the County- ; City Building, said Julia Michalak, a member of the South Bend Area Council of Catholic Women. : COUNTY ATTORNEY Anthony Zappia said he was contacted Tuesday by representatives of the ; Jewish group. ; Kim Marsh, executive vice president of the federation, said, : “Our constitution protects the right that no one religion can be favored . over another. That’s why the creche, which is purely a religious symbol, is inappropriate. “This period of year is a time . that requires great sensitivity from : all people,” Marsh said. I After spending several hours : researching pertinent cases, Zappia said that despite strong personal ; beliefs, he decided there was no ; choice but to recommend the creche be taken down. “It’s one of those things I had to do,” he said. “I would have been dilatory in not recommending that

Cool greeting for cards with Christmas-Hanukkah symbols

it be removed because the display subjected the county to potential litigation and attorney fees. The law is very clear on this.” THE OPINION WAS issued after a protest by attorney Robert Rosenfeld on behalf of the community relations committee of the Jewish Federation. There was no discussion of what action his group would have taken if the display had not been removed, Rosenfeld said. Rabbi Morley Feinstein of Temple Bethel said, “We, by no means, are making a comment against Christmas. We support the freedom to celebrate religious holidays, but it’s not right in public schools or in government buildings.” Zappia’s ruling was based on a U.S. Supreme Court ruling issued last July in a case known as County

Michalak said she was upset when she learned the Nativity scene was removed. “WE HAVE BEEN doing this for 39 years. We feel it has never brought about any ill will, never caused any riots or treaded on anyone’s human rights. We thought it helped bring about good will,” said Michalak. “We feel it’s a shame that the community must be ruled by nine people in Washington, D.C., who would seem to have more important things to do than to make a ruling in such innocent displays. If anyone finds the display offensive, then we find their attitude most offensive,” she said. The Christmas tree also must

come down. “The Christmas tree is an adjunct to the crib, which is the focal point of the Christmas celebration,” said Michalak. “The decorated tree does not have meaning without the crib.” County Commissioner President Joseph Zappia said, “This has never come up before.” THE DISPLAY WAS “a normal routine thing. No one ever complained.” “Next year I hope we can talk early to the various religious groups to see if we can come to a solution.” Michalak said her group also expects to be involved next year. “I hope we might be able to initiate something to reverse this, but we really haven’t had time yet together.” SHE SAID THAT might mean going through the legal process if that is the only way to reverse it Feinstein emphasized that the Jewish community is attempting to preserve their right to freedom of religion at a time of year when they are celebrating Hanukkah, the festival of lights that grew out of a fight by Jews to preserve their right to practice their religion long ago. “Having the Nativity on public land is not appropriate. It does not support the law of the land,” said Feinstein. “OLD CUSTOMS DIE slowly,” Rosenfeld said.

Races exchange bows in new Methodist hymnal

NEW YORK (AP) Blacks pay respects to whites and whites pay respects to blacks in a new United Methodist hymnal being distributed to congregations across the country. The mutual consideration is reflected in the lyrics as well as in the broad range of selections, from European-derived classics to slave spirituals. Female also gets included along with male in the language about people, such as substituting “all” for “men.” But references to God and Jesus remain mostly male. “THERE WERE trade-offs,” says the Rev. Carlton R. Young, editor of the hymnal, whose repertoire of 625 numbers includes 300 new ones. Many are evangelicalstyle gospel songs and black spirituals. “It was a process of give-and-take, which is how Methodists have stayed Methodists all these years,”

he said in a telephone interview from his Nashville, Tenn., office. For example, in the newly included black spiritual “Every Time I Feel the Spirit,” the ethnic pronunciation is “Ever Time Ah Fil de Spirit,” but the book puts the song in standard English. “To put it in dialect would have been very ill advised,” said the Rev. William Farley Smith, a Harlem pastor and member of the hymn committee that compiled the new book, replacing a 1966 version. “THAT WOULD have turned off whites and made it so only ethnics would sing it. This would detract from the original intent and be discrimination in reverse. It would have left out all the Anglos. “They’re not used to the ethnic pronunciations. But blacks know it already and sing it In the book, we put the words in proper English so as to accommodate whites."
