Attorney for Dr. Thakkar files countersuit charging slander
: ANDERSON, Ind. (AP) An attorney for a woman who accused Frankton physician Pravin Thaakar Of aborting her fetus without her consent says Thaakar’s slander suit contains nothing new and that hospital records it cites support her Story. Tile slander suit was filed Tuesday for Thaakar as he appeared before a federal magistrate and learned there was probable cause for criminal charges alleging he attempted to skirt federal banking regulations requiring government notification on transactions of SIO,OOO or more. ATTORNEY JEFFREY Lockwood filed the slander suit in Madison Superior Court against Carmen Hertzinger, 34, of Anderson, alleging repeated statements she gave to the media have damaged Thakkar’s reputation and career. Hertzinger sued the 38-year-old doctor, alleging he impregnated her in 1983 while she was a patient of his and then, during the eighth
State investigating fur store’s sales to Josie Orr after she signed paper as resident of Colorado
INDIANAPOLIS (AP) Authorities are investigating an Anderson fur retailer for allegedly falsifying records to avoid state income and sales taxes, and former Indiana first lady Josie Orr was one of the customers involved in the scheme, according to a television station. WISH-TV reported Tuesday that Mrs Orr, wife of former Gov. Robert D. Orr, signed a document certifying she was a resident of Colorado at the time she was living in the governor’s mansion. MRS. ORR AT THE time was purchasing a fur from Anderson Fur Co., the target of the investigation by state police and the Indiana Department of Revenue, the station reported. The fur was valued at more than SI,OOO. The Orrs at the time owned a condominium at the ski resort of Vail, Colo., and still own it, along with residences in Indianapolis and

month of her pregnancy, drugged her and aborted the fetus without her consent. A second Anderson woman, Kathy Collins, filed a similar suit, alleging Thakkar used a medical instrument to abort her fetus during a 1987 medical examination. BOTH LAWSUITS are pending, as is another lawsuit by Collins seeking to freeze Thakkar’s assets. The slander suit contends Hertzinger was still pregnant with the fetus in question Dec. 9, 1983, 41 days after the alleged abortion and checked into St. John’s Medical Center in Anderson for treatment She was discharged three days later still carrying the baby, it claims. Lockwood said he saw records of a medical examination that confirm Hertzinger was pregnant in December 1983. He said the suit contends the woman “reported being nine months pregnant and that she had not felt life for four weeks. Hertzinger was told the baby she

was carrying was dead and probably had been for about two months.” SHE RETURNED TO the medical center less than a month later, Jan. 6,1984, and told medical staff she had miscarried a sVtmonth old fetus two days earlier, according to Thakkar’s lawsuit. No explanation was given on the varying ages of the alleged fetus. The slander suit said Hertzinger was Hertzinger’s attorney, Robert York of Indianapolis, said he was surprised by the lawsuit and suggested it was a “desparate act” by Thakkar. He said his client concealed the abortion when she went to the hospital because of threats by Thakkar. “WE HAVE BEEN aware of those medical records, and they are very consistent with what Carmen Hertzinger has been saying all along,” York said. “I am comfortable that there is nothing in those records that contradict what Carmen Herzinger has been telling
sources it did not identify, said Mrs. Orr benefitted from a practice in which fake shipments were made out of state so some in-state customers could avoid paying Indiana’s 5 percent sales tax. The tax on a SI,OOO purchase would have been SSO. Mrs. Orr could not be reached Tuesday night at her Indianapolis or Evansville residences. However, Orr, whose appointment by President Bush to be U.S. ambassador to Singapore is awaiting Senate confirmation, told the station his wife purchased a fur at Anderson Fur Co. and asked that it be sent to Colorado so she could receive it when she went on vacation. He said the fur was delivered to Vail condo. THE FORMER governor said he did not know whether she paid sales tax on the fur, but that she was not the target of an investigation.
everybody.” U.S. Magistrate Kennard P. Foster ruled in Indianapolis there was probable cause for charges Thakkar attempted to skirt federal banking regulations with withdrawals of nearly SIO,OOO over six weeks. Bank transactions of SIO,OOO or more require notification forms be sent to the federal government The law is designed to inhibit money laundering operations. If convicted, Thakkar could be sent to prison for five years and fined $250,000. WITH TUESDAY’S ruling, federal prosecutors must present their case to a grand jury within 30 days. Thakkar was arrested May 8 after authorities said he made 14 bank transactions totalling $132,000. He is free on $35,000 bond. Thakkar’s medical license was suspended Feb. 11 after 11 women, including Hertzinger and Collins, testified before the state medical licensing board and accused him of sexual misconduct.
“The way Indiana law works, even if the allegations are true, it would be the Anderson Fur Company, not Josie Orr, legally liable for that tax,” Orr told the station. Orr was governor of Indiana from 1981 until January.
