HUMPHREYS AND JOYCE HUMPHREYS TO VACATE THAT PORTION OF WILLIAM STREET FROM ITS INTERSECTION WITH FRAZIER STREET ON THE NORTH TO ITS INTERSECTION WITH JONES STREET, AS ORIGINALLY PLATTED, ON THE SOUTH. WHEREAS, Phillip E. Humphreys and Joyce Humphreys, at the regularly scheduled meeting of the Greencastle Common Council held on Tuesday, May 14,1985, petitioned the Common Council of the City of Greencastle, Indiana, to vacate that portion of William Street from its intersection with Frazier Street on the north to its intersection with Jones Street, as originally platted, on the south, and; WHEREAS, the Common Council of the City of Greencastle, Indiana, has, pursuant to law, published notice of the fact that this matter would come on for public hearing at the regularly scheduled meeting of the Common Council of the City of Greencastle, Indiana, to be held on Tuesday, June 11, 1985, at 7:30 P.M. in the City Building, Greencastle, Indiana. and; WHEREAS, the Common Council of the City of Greencastle, Indiana, has, after said public hearing, determined that the relief prayed for in said petition should be granted and that that portion of William Street from its intersection with Frazier Street on the north to its intersection with Jones Street, as originally platted, on the south, sought to be vacated should be vacated, and; WHEREAS, the vacation of this city street has been submitted to the Greencastle Plan Commission and such Plan Commission has issued its report recommending that such request be granted, and; WHEREAS, all the adjoining landowners affected by such vacation have been notified by certified mail, return receipt, and the City Attorney has received signed return receipts from such adjoining landowner, and; WHEREAS, there having been no objection noted at the public hearing on said petition, NOW THEREFORE, be it ORDAINED by the Common Council of the City of Greencastle, Indiana, that that portion of William Street from its intersection with Frazier Street on the north to its intersection with Jones Street, as originally platted, on the south, is hereby vacated as a public street of the City of Greencastle, Indiana. That this vacation be subject to the existing easement for sewer lines with all rights of ingress and egress to such sewer lines and the right to maintain and replace such sewer lines and this vacation shall also be subject to such reservation of sewer line easements. That this Ordinance shall have full force effect of law immediately upon its passage by the Common Council, signature by the Presiding Officer of the Council and approval by the Mayor.
