Ruling affects religious commercial activity
Foundation must pay minimum wage: Court
c. 1985 N.Y. Times News Service WASHINGTON The Supreme Court ruled unanimously Tuesday that religious organizations must pay the federal minimum wage to workers engaged in commercial activity. The court said the law applies even if the workers insist that their labor is part of a religious mission for which they want no pay. In an opinion by Justice Byron R. White, the court said that the “test of employment” under the Fair Labor Standards Act, which governs minimum wages and hours, is “one of economic reality.” If employees could decline the law’s protections, White said, “employers might be able to use superior bargaining power to coerce employees to make such assertions.” He said the result would be “a general downward pressure on wages in competing businesses.” The court ruled in favor of the Department of Labor in a long-running enforcement action against the Tony and Susan Alamo Foundation, an evangelical Christian organization that runs several dozen commercial enterprises in four states. The businesses, staffed by 300 unpaid “associates” who often work 12 or more hours a day, include hog farms, a roofing company, a motel and gasoline stations. The foundation, which is incorporated as

It argued that its various businesses were “churches in disguise,” part of its religious mission, and that application of the federal wage law would violate the associates’ First Amendment right to the free exercise of religion. The foundation lost in both the U.S. District Court in Arkansas and in the Bth U.S. Circuit Court of Appeals, which said that “there is surely no constitutional right, under the religion clauses of the First Amendment, to pay substandard wages.” White said Tuesday that if the workers had religious objections to receiving

money, they could donate their pay to the foundation. “We therefore fail to perceive how application of the Act would interfere with the associates’ right to freely exercise their religefs,” he said. White said that the associates were employees within the meaning of the Fair Labor Standards Act because they engaged in “ordinary commercial activities” in “expectation of compensation.” While they did not expect cash, he noted, testimony in the case indicated that they viewed themselves as receiving room, board and clothing in return for their work. The court noted that under the Fair Labor Standards Act, the minimum wage does not necessarily have to be paid in cash, but can include benefits of

equivalent value such as room and board. There is a separate proceeding now before the District Court on the foundation’s back-pay liability, in which the value of the non-cash benefits will now presumably be calculated. The foundation had warned that a ruling against it would require payment of the minimum wage to members of traditional religious orders as well as to volunteers in church-sponsored activities and in nonprofit enterprises such as the Red Cross. White said there was no reason to believe that “ordinary volunteerism” would be brought within the statute. The case, Alamo Foundation vs. Secretary of Labor, No. 83-1935, was the first of the term’s religion cases to be decided. It was argued less than a month ago, on March 25, an unusually short interval between argument and decision. Most of the other religion cases, including the constitutionality of a “moment of silence” in public school classrooms and two cases concerning aid to parochial schools, were argued in late 1984 and are evidently proving more troublesome for the court. The Alamo foundation has engendered controversy since its founding in 1966 by a husband and wife who began their religious ministry handing out Bible tracts on Sunset Strip in Hollywood. Its net worth is now estimated at up to S6O million.
