He lives WHERE? Hoosier legislator moves to Milwaukee, but still wants to represent Allen County

FORT WAYNE. Ind. tAP) - State Rep. James Hunt. R-Fort Wayne, has moved to Milwaukee but says he still wants to represent Allen County residents in the Indiana Legislature. The law. according to Hunt, simply states he must have been a resident of the 14th District at the time he was elected in November 1978. Hunt, a management-labor relations adviser for Allen Bradley Co., which manufactures electronic components, said the law makes no reference about residency requirements after an election. He moved to Milwaukee three weeks ago to take the job with Allen Bradley. In a telephone interview Thursday with the Fort Wayne Journal-Gazette, Hunt said constituents wanting to reach him should call his legislative aide, Doug Gilley. Hunt said he installed a phone in his name at Gilley’s home in Fort Wayne. Allen County Republican Chairman Orvas Beers said he

EVANSVILLE, Ind. (AP) - Authorities have a week to file charges against a Vanderburgh County sheriff’s deputy arrested after a raid uncovered stolen property at his home. John H. Shackelford, 36, waived a preliminary hearing in Vanderburgh Misdemeanor Court Wednesday and posted a S2OO cash bond. Shackelford, a six-year veteran of the department, was arrested Tuesday after four pieces of stolen construction equipment were found at his home. State Police Det. John Ran-

ROCKPORT, Ind. (AP) - Who gets the $2,500 reward for finding the body of Kathy Kohm, 11, of Christmas Lake Village, is to be decided within two weeks by Judge Wayne Roell of Spencer Circuit Court. The child disappeared from her home April 5, and her body was recovered June 11 In a wooded area less than a mile from her home. State police said she died from a single gunshot wound to the head. doesn’t like this long-distance representation one bit. ‘‘l have not been contacted by Mr. Hunt whatsoever about his move to Milwaukee,” Beers said Thursday. “It is absolutely inconceivable for anyone to think he could represent the 14th District and live out of state.” But Hunt said he believed it would be unfair to his constituents to step down now shortly before the 1982 session begins and send an inexperienced replacement to finish his term. Hunt said Beers apparently “did not disapprove” of his plans to represent constituents from 225 miles away because Beers never called him to complain. “I have never tried to hide what I am doing,” he added. Rep. Richard Worden, R-Fort Wayne, said he hopes Hunt will resign his seat before January when the Legislature meets again. But if Hunt doesn’t, some lawmakers may try to force him out, he added.

Kentucky may renege on boundary settlement

INDIANAPOLIS (AP) - Indiana Attorney General Linley E. Pearson says he “was a little shocked” that Kentucky’s attorney general “personally attacked” him over the two states’ recent out-of-court settlement of the Ohio River boundary dispute. “It (the settlement) must have upset him a great deal,” Pearson said Thursday as he disputed Steve Beshear’s claim Pearson had made it appear Indiana made no concessions in the settlement. Pearson responded after Beshear told a news conference

dall Baily said the investigation is continuing and more arrests are expected. According to Baily, a bulldozer and flatbed trailer recovered at Shackelford’s home are believed to have been stolen from Hopkinsville, Ky. A tractor found in the raid is believed from Henderson, Ky. A backhoe at Shackelford’s home apparently belongs to a Newburgh construction company, the detective said. Federal authorities are participating in the case because it involves interstate transportation of stolen property.

claiming the reward or a portion of it. They include Jack Harry, on whose property the body was found; Harold Byers and his grandson, Steven, 14, who discovered the body, and Jeff Fox, a New Castle psychic who telephoned police with a description of where the body could be found. The reward money was donated by area individuals for information leading to the whereabouts of the girl. Grundhoefer said the association filed a lawsuit when

Worden, who represents the 15th District and worked with Hunt at International Harvester in Fort Wayne nearly nine years, said the issue may come up Nov. 16 when Republicans caucus. Even if it’s legal for Hunt to live in Wisconsin and serve in Indiana, Worden said he thinks long-distance representation is improper. Hunt has returned to Fort Wayne twice since he moved away and is to be in the city this weekend. “If I felt the constituency was not getting the proper service for its complaints and problems, I would simply resign,” Hunt promised. Hunt, the only Allen County member of the House Ways and Means Committee, said hifiv first concern is for his constituents. He said he would attend the November meeting to decide what is best. If many of the lawmakers want him to resign, Hunt said he would reassess his position.

We’re pleased with it, and I don’t want to mess it up.” When the settlement was announced Tuesday, Pearson told reporters Indiana was dropping its objections to the Louisville port and Kentucky was retaining islands in the Ohio

Baily said. A fifth piece of equipment was found Wednesday at the home of a relative of another member of the sheriff’s department who allegedly purchased it from Shackelford. Lt. Gary O’Risky, commander of the county’s investigation unit, said information obtained in an interview with Shackelford led them to the home of Willard Strange, father of deputy Phil Strange. O’Risky said he is convinced Willard Strange did not know the vehicle was stolen. “He pur-

300 inmates to move by 1984

'Cut state prison population'

INDIANAPOLIS (AP) - On orders from a federal judge, state officials are already looking at ways to move more than 300 inmates from the Indiana State Prison to get the population down to 1,615 by 1984. “The judge’s order apparently requires an immediate beginning of this reduction. I thirk what he’s essentially saying to us is that we must not put more people in there.,'’ gubernatorial aide Kendall W. Cochran said Thursday. “That will make an already difficult situation more difficult. But it is still a manageable situation.'’ U.S. District Judge Allen Sharp of South Bend ruled Thursday in a class-action lawsuit by 12 inmates at the century-old prison at Michigan City. The inmate-plaintiffs claimed the crowding amounted to cruel and unusual punishment. Sharp also awarded SSOO in damages to inmates James Odis Hendrix and Grady Bobbitt and SI,OOO to inmate Mellon Carroll. “The most serious problem at the prison is simple crowding,” Sharp said in his 165-page order.

Westville guards facing drug arrests

INDIANAPOLIS (AP) Arrests of several more guards for bringing marijuana, LSD and other illegal drugs into the Westville Correctional Center are expected, a state police liasion for the institution says. State Police Detective Sgt. Arland D. Boyd would not say Thursday how many of Westville’s 300 guards are suspects in the investigation. “There was no tight knit group bringing drugs in everybody seemed to be working on their own,” Boyd said. Investigators are now using several inmates to get in-

River that had paid taxes to the commonwealth for years. But Kentucky’s attorney general told reporters Thursday Indiana was claiming ownership of seven islands in the Ohio. Pearson also noted Beshear didn’t handle the case. That was left to outside lawyers, he said. “I don’t know whether he realizes it or not, but the 1911 survey line is the same as the Geological Survey line on 70 percent of the river,” Pearson said. If Kentucky reneges on its part of the agreement, as

chased the tractor in good faith,” O’Risky said. “They (the Stranges) are not involved in any way.” Officials said they did not know the origin of the tractor removed from the Strange residence because serial numbers had been removed. O’Risky said several people who reported tractors missing will be allowed to examine it to determine if it is theirs. Immediately after his arrest, Shackelford was placed on indefinte suspension by Sheriff James DeGroote.

money. No arrest has been made in the slaying.

“In the context of the physical plant and the limits on staffing, this crowding constitutes a violation of the Eighth Amendment of the Constitution of the United States,” he added. “This court reaches this conclusion with the greatest reluctance, but the facts compel the conclusion.” Sharp’s order gives the state until Dec. 31,1982, to reduce the Michigan City prison population from the current 1,941 to 1,750. By Dec. 31, 1983, the population

must be trimmed to 1,615. Sharp set 1,615 as the permanent ceiling on the population at the prison, given its present facilities. Sharp said all inmates housed in the maximum security area must be let out of their cells for three hours a day, instead of the current half hour. Outdoor exercise must be an option for the prisoners during one of the three hours, he said. “That will cause us a

The federal judge had words of praise for Warden Jack Duckworth. “Warden Duckworth did not build the prison nor invite all of its numerous inmates to be his guests in its cramped confines. It is human nature to try and get the most for the least. Being human, many investors have plunged headlong into money market funds (not to be confused with money market certificates issued by financial institutions). Now a highly respected investment analyst* is waving a red flag! "Keep in mind," he says, "that commercial paper (often constituting the bulk of money market fund portfolios) is nothing more than an unsecured 10U..." Some economists say we are in a recession. Recession and continuing high interest rates cause more bankruptcies. And more bankruptcies threaten many money market funds. Concludes our investment analyst: investors choosing to minimize risk should avoid money market funds which are not invested 100% in government securities, even though this may net a lower return. Which makes sense to us. What makes even more sense is to invest in money market certificates at Greencastle Federal. Why? Your interest is competitive because it is geared to market rates. day basis. Neither can the warden control the number of prisoners the criminal justice system of Indiana sends him.” Gordon Faulkner, commissioner of the Indiana Department of Correction, said he hadn’t had an opportunity to see the full order. But he said that if the order was limited to those population reductions, “we don’t feel we’ll have an overall problem with it.” From the governor’s office, Cochran said the state had been prepared for Sharp’s ruling. “We knew this was coming at some point or suspected it wSI Planning has been going on for several years to deal with crowding,” he said. Cochran said there will be no problem reassigning some inmates at the maximum security facility to other correctional institutions in the state. “There are folks at the prisoh that can be safely incarcerated in the other institutions. We don’t have just the total, hard core, bad guys at Michigan City,” he said. Cochran said some prisoners could be furloughed early, if necessary, “but we don’t even contemplate that.” > “If people have to be turned out,” Faulkner said, “the people classified minimum security are the people who would leave.” In addition, Cochran said, there are plans to add beds at the Indiana Youth Center Ua Plainfield, the Indiana State Reformatory at Pendleton and the Westville Correctional Center. This will add more than 600 beds, he said.
