law, we can’t keep the students from parking on the street. The students can park on the street. You can’t tell a kid he can’t drive a car and park on Washington Street. That’s a public road.” The board members explained there has been earlier concern about the traffic situation near that location and they were trying to consider all possibilities. “Was there no other site 0 ” Vermillion questioned. “WITH THE SQUARE footage and the location for all the schools, this was the best site for feasibility and economy,” Archer answered. The request met with no objections from the board. Other variances approved by the board were tor a two-year trailer variance on Route 3, Greencastle, for J. M. Sexton, and the request of Mr. and Mrs. Robert Huffman to construct a garage at 805 Hillcrest Drive in Greencastle. ALSO APPROVED WERE the requests of D. C. Rattray, residing on West Walnut Street in Greencastle, to use a portion of the home for an antique business, and of Mr. and Mrs. John Zeiner to erect a pool on their property. Following the decisions made by the board members, an appeal was read from City Councilwoman Mary Frances Strain concerning two earlier decisions made by City Engineer Cliff Norton. The appeal questioned the granting of a permit to the Murphy Brothers Real Estate concerning the placing of a home on a lot on Crescent Drive in Greencastle. THE APPEAL FROM Ms Strain charged the application “did not include all necessary information, the neighbors were not given all the information necessary in their notification, no mention was made of the structure being modular nor were any dimensions given. The scale drawing of the lot was not to scale, the drawing did not indicate a 20-foot setback which does not meet requirements for that

In southern Indiana, a Jeffersonville truck driver was arrested Thursday as truckers continued to block fuel pumps at four truck stops in the vicinity of 1-65. Robin Dean, state police communications officer at the Charlestown post, said trucker William Been, 36, of Jeffersonville, was arrested on a charge of criminal trespassing at the Hamburg Service Center off 1-65 in Clarksville. A spokesman at the Clark County Jail in Jeffersonville said Been was released after posting a $1,500 bond. At the Key Truck Stop in Clarksville, a produce truck was permitted to load

area, and the deed recorded on Jan. 4 does not describe the east side of the lot nor give a dimension for it.” It concluded, "Therefore, I (Ms. Strain) charge the application was false in its information, that several matters required variance from Zoning Board and a permit should not have been issued until these matters were properly decided by the board at the April meeting. That the enginner (Norton) was aware of these unmet requirements at the time of his issuing the permit, and if the Zoning Board attorney (Roy Sutherlin) instructed him to issue the permit, then he too, is charged with not acting in the best interest of the public and his responsibility to the city.” , NORTON EXPLAINED that when the application for the home was made it did not meet the 7,200-square-footage requirement. It was then that Norton referred the matter to the board. Norton then received a plat from County Surveyor Alan Stanley with a charge in the square footage due to additional land purchased at the location by Murphy Brothers. “That brought the depth to 120 feet which brought the square footage to the 7,200-square-foot minimum, so we issued a permit,” Norton said. CONCERNING ALLEGATIONS the building was modular in design, Norton said the building was not modular because it was brought to the location on a flatbed truck. A board member noted if the structure could be mounted on wheels, it is, by definition, a trailer. “I want to know what the definition of a trailer is,” Tzouanakis interjected. “I don’t want to call it something one month, then call it something else the next. ’ ’ “I stand for certain things,” he added. “It’s either black or white. I don’t want to be accused of playing favorites.” THE BOARD DELIBERATED on whether a building could be described as modular because it is transported on

enough fuel to continue on its way, said cashier Barbara Miller. Otherwise, the pumps were idle at the four locations blocked by about a dozen trucks, authorities said. The truckers say they are being squeezed out of a living by the rise in diesel prices, which have climbed to as high as $1.29 a gallon when the fuel is available. They want a mandated rate surcharge so they can pass along fuel costs without losing ground to their competition, as well as uniform state regulations on the size and weight of loads. “I’m flat going bankrupt.” said Alan Jozwiak, an independent trucker from Kentwood, Mich. “My truck is not rolling now. If I go broke, I’m going broke sitting at home, not on the road someplace.”
organizations devoted to the study and preservation of American Architecture and has been active in the work of the commission in the Lockerbie Square and other historic areas of the city of Indianapolis. Transportation hearing set
INDIANAPOLIS (AP) - The Rural Transportation Advisory Task Force has scheduled a hearing July 26 in the Hoosier capital to discuss transportation problems facing farmers. Under a law enacted by the last Congress, the task force has the responsibility to
wheels. They charged a house could also be put on wheels but that does not indicate the structure would then be classified as a trailer. The problem in determining whether the building would be classified as modular stemmed from a court decision by Circuit Court Judge Francis N. Hamilton on Oct. 5,1978. The Zoning Board used Hamilton’s decision as a basis for their discussion concerning the classification. HAMILTON ORDERED, “That a trailer is defined “as any vehicle or structure so designed that is or may be mounted on wheels and used as a conveyance on highways.” No further discussion was held by the board concerning the clarification of the matter. Norton then explained the charge concerning the issuing of a permit to Don Kiger concerning the operation of a scrap metal yard south of the Conrail railroad tracks and west of U.S. 231 on the city’s south side. THE APPEAL BY Ms. Strain questioned the operation of the scrap yard and stated there was not a permit given nor permission recorded as such. Norton said the operator (Kiger) has a contract with Greencastle Manufacturing to store material until it can be disposed of. “A contractor storage yard is allowable,” Norton said. He added one permit has been allowed for the use of the south side of the railroad tracks. The board agreed to stand by the decisions made by Norton concerning both matters. IN FINAL ACTION, the board asked that Mrs. Pat Clodfelter reapply with the city engineer for a variance to erect a modular home on Route 2, Greencastle on Cemetery Road. The decision was made because the original request asked to locate a doublewide home at the site, but was then changed to a single-wide home.
