CITY ADVERTISEMENT Kotice is hereby given of the passage of the following ordinance, to-wit: AN ORDINANCE AMENDING THE ZONING ORDINANCE OP THE CITY OB' MUNCIE, INDIANA, PASSED BY VHE COMMON COUNCIL ON SEPTEMBER 3, 1923, AND ALL ORDINANCES AMMENDATORY THEREOF OR SUPPLEMENTARY THERETO WHEREAS the Common Council of the City of Muncie, Indiana, deems it neces•ary in order to conserve the value of property in the city and to the end that adequate light, air, convenience of access, and safety from fire, flood, and other dangers may be secured; that congestion in the public streets may be lessened or avoided; and that the public health, •afety, comfort, morals, convenience and general public welfare may be promoted in a manner which recognizes the needs of industry and business in the future growth of the city and will encourage the development of healthy surroundings for family life in residential neighborhoods; all in accordance with a Master Plan de•igned to assure efficiency and economy in the process of development of the city, and for the purpose of: a. Classifying, regulating and limiting the height, area, bulk and use of buildings hereafter to be erected; b. Regulating and determining the area of front, rear and side yard and other open spaces about
buildings;
0. Regulating and determining the use and intensity of use of land and
lot areas;
4. Classifying, regulating and restricting the location of trades, callings, industries, commercial enterprises and the location of buildings designed for specified uses; •. Dividing the city into districts of such kind, character, number, shape and area as may be deemed necessary to carry out the purposes of
this ordinance.
NOW THEREFORE, BE IT .ORDAINED by tha Common Council of the City of Muncie, Indiana, that the Zoning Ordinance of the City of Muncie. Indiana, passed by the Common Council on September 3, 1923, and all ordinances amendatory thereof and supplementary thereto, ba. and the same is. hereby amended by striking out the entire text of said ordinanco and its several amendments and supplements, and the districts and their boundarlss. as shown on tha Zone Map accompanying said ordinance, and substituting therefor the following sections end
Zone Map:
SECTION I. DISTRICTS AND ZONE MAP.
The City of Muncie is hereby divided into seven (7) districts in order to carry out the purposes of this ordinance. These districts shall be known as follows: R-l Single-Family Residential District R-2 Single-Family Residential District R-3 Two-Family Residential District M-l Multiple-Family Residential Dis-
trict
C-l General Commercial District C-2 Neighborhood Commercial District 1-1 Industrial District The Zone Map, which accompanies and is hereby declared to be a part of this ordinance, shows the boundaries of and the areas covered by the above districts. Notations, references, indications and other matters shown on the Zone Map are as much a part of this ordinance as if tlrey were fully described in the text of the ordinance. In determining the boundaries, and establishing the regulations applicable to each district, due and careful consideration has been given to existing conditions, the character of buildings erected in each district, the most desrable use for which the land in each district may be adapted, and the conservation of property values throughout the city. Where uncertainty exists as to the exact boundaries of any district as shown on the Zone Map, the following rules shall
apply:
1. W
Where district boundaries are Indicated as following street, alley or lot lines, or approximately along such lines, such lines shall be construed to be the district boundaries. 2. In unsubdivided areas, or where a district boundary subdivides a lot, the exact location of the boundary shall be determined by use of the
scale of the Zone Map.
3. In the case of further uncertainty, the Common Council shall interpret the intent of the Zone Map as to the location of the boundary in
question.
Territory which may hereafter be annexed to the City of Muncie shall immediately be included in the R-l SingleFamily Residential District, until changed by amendment to this ordinance. Wheneever any street, alley, public way, railroad right-of-way or other similar area, is vacated by proper authority, the districts adjoining each side of such street, alley, public way, railroad right-of-way or other similar area, shall be automatically extended to the center of such vacation and all area included in the vacation shall then and thenceforth be subject to all appropriate regulations of the extended
districts.
SECTION 3. GENERAL PROVISIONS
RELATED TO BUILDINGS. Except as hereinafter provided: 1. No building shall be erected, reconstructed or structurally altered, nor shall any building or land be used, for any purpose other than a use which is permitted in the district in which such building or land is
located.
2. No building shall be erected, reconstructed or structurally altered to exceed in height the limits established for the district in which su^h building is located. 3. No building shall be erected, reconstructed or structurally altered in any manner which will encroach upon or reduce in any manner, the yards, lot area per family or size of building regulations established for the district in which such building is located. 4. Every building hereafter erected shall be located on a lot, which fronts on a street, and in no case shall more than one building and its customary accessory buildings be erected on any lot. SECTION 3. R-l SINGLE-FAMILY RESIDENTIAL DISTRICT а. USE. No building or premises shall be used, and no building shall be erected, reconstructed or structurally altered, which Is arranged, intended or designed to be used for other than the following uses, unless otherwise provided herein: 1. Single-Family Dwelling. 2. Church or other building for religious worship. 3. Public School, Elementary or High, and Educational Institutions having courses of study equivalent to those of public schools. 4. Fraternity or Sorority Houses for College Students. 5. Boarding or Lodging Houses for bona-fide College Students or Facб. Public Park or Public Playground and essential Accessory Buildings
thereof.
7. Accessory Buildings, including Private Garages and Quarters for bona-fide servants employed by the occupants of the residence on the same lot. provided that no Accessory Building may be erected or used prior to the erection of the principal residence building on
the lot.
8. Vegetable and Flower Gardens, Orchards and Farming, but not the raising of livestock or poultry, and provided that ho sighs, displays or sales stands are used in conjunction therewith.
9. Church or Public Building Bulletin Board, not exceeding ten (10) square feet in area. 10. Signs of a temporary character, not exceeding six (6) square feet in area, pertaining to the lease, hire, or sale of a building or premises, which signs shall be removed as soon as the building or premises has been leased, hired or sold. b. HEIGHT. No building hereafter erected, reconstructed or structurally altered. shall exceed thirty-five (35) feet, or two and one-half stories in height. C. INTENSITY OF USE OF LOT. 1. No building, with its accessory buildings, shall occupy in excess of thirty per cent (30 r /c) of the area of an interior lot, nor in excess of thirty-five per cent (35%) of the area of a corner lot. 2. No building shall be erected on any lot having an area of less than seven thousand five hundred (7500) square feet or a mean or average width of less than fifty (50) feet. d. SIZE OF BUILDING. No building shall be erected for residence use. having an area on the ground floor, exclusive of open porches or terraces, of less than seven hundred fifty (750) square feet. e. YARDS. Every residence building erected shall provide a Front Yard between the front line of the building and the street line; a Side Yard between such building and each lot line other than a street line or a rear line; and a Rear Yard between the rear line of the building and the rear line of the lot; within which yards no building or portion thereof shall be erected, reconstructed or structurally altered, except as hereinafter provided. 1. FRONT YARD. (a.) The Front Yard shall be equal to not less than twenty per cent (20%) of the depth of the lot, but need not exceed fifty (50) feet. (b.) Where two or more lots, comprising twentv-five per cent (25%) or more of the frontage in any block are developed with buildings which have front yards with a variation of not more than six (6) feet, the front yard in the block shall be established by such buildings. (c.) A Front Yard or Building SetBack Line established in a recorded subdivision, which is at least twenty per cent (20%) of the deoth of the lots, shall apply as the Front Yard Line in such blocks. (d.) Buildings on Through Lots shall provide the required Front Yard
on each street. Where Front Yards have been established, or may be established, on lots fronting on two intersecting streets, a corner lot located at the intersection of the two streets, shall pro vide Front Yards parallel to both streets conforming to the Front Yards required
eac street, provided that the building area on the corner lot need not be reduced below thirty (30) feet In width, measured perpendicular’y *.o the side street. Provided further that no accessory building located on such lot shall project beyond the Front Yard Line established along the side line of the corner lot. (f.) No detached accessory building shall oe i-rected closer to the front line of a lot than seventy-five (75) feet. 2. SIDE YARD. There shall be a Side Yard on each side of every lot, the total width of which side yards shall be not less than twenty per cent (20%) of the mean or average width of the lot, and in. no instance shall the width of either side yard be less than four (4) feet. 3. REAR YARD. There shall be a Rear Yard or not less than twenty per cent (20%) of the depth of the lot, provided that such Rerr Yard shall be not less than twenty-five (25) feet and need not exceed thirty-five (35) feet. f. USE OF LOTS DEFICIENT IN AREA OR WIDTH. A single lot which was a lot of record or was in single ownership at the time of passage of this ordinance, even though It may be deficient in area or width as prescribed herein, may be used as a building lot for a single-family dwelling, if additional frontage on either side of the lot was not under the same ownership at the time of passage of this ordinance and can not be reasonably acquired, as determined by the Board of Zoning Appeals, so as to meet the reouirements for the district in which such lot SECTION 4. R-2 SINGLE-FAMILY RESIDENTIAL DISTRICT a. USE. The Use Regulations are Identical with those prescribed herein for the R-l Sincle-Family Residential District. b. HEIGHT. The Height Regulations are identical with those prescribed herein for the R-l Single-Family Residential District. c. INTENSITY OF USE OF LOT. 1. No building, with its accessory buildings, shall occupy In excess of thirty per cent (30%) of the area of an interior lot. nor in excess of
thirty-five per cent (35%) of the area of a corner lot. 2. No building shall be erected on any lot having an area of less than four thousand eight hundred (4800) square feet, or a mean or average width of less than forty (40) feet. d. SIZE OF BUILDING. No building shall be erected for residence use, having an area on the ground floor, exclusive of pen porches and terraces, of less than ix hundred (600) square feet. e. YARDS. The Front, Side and Rear Yards Regulations are identical with those prescribed herein for the R-l SingleFamily Residential District. f. USE OF LOTS DEFICIENT IN AREA OR WIDTH. The Regulations under this Title are identical with those prescribed for the R-l Single-Family Residential District, herevin. SECTION 5. R-3 TWO-FAMILY RESIDENTIAL DISTRICT a. USE. No building or premises shall ne used, and no building shall be erected, reconstructed or structurally altered, which is arranged, intended or designed to be used for other than the following uses, unless otherwise provided herein; 1. Uses listed under this Title in the R-l Single-Family Residential District. 2. Two-Family Dwelling. 3. Three-or-Four-Family Apartment. 4. Boarding or Lodging House. 5. Tourist Home. b. HEIGHT. The Height Regulations are identical with those prescribed herein for the R-l Single-Family Residential District. c. INTENSITY OF USE OF LOT. 1. Buldings, with their accessory buildings, shall not occupy in excess of the following percentages of lot areas: (a) Single-Family Dwellings: Thirty per cent (30%) of the area of interior lots and thirty-five per cent (35%) of the area of corner lots. (b) Two-Family Dwellings dr Apartments: Forty per cent (40%) of the area of interior lots and forty-five per cent (457e) of the area of corner lots.

(c) Apartments for more than four families: Sixty per cent (60%) of the area of any lot. 2 No building shall be erected except in conformity with the following requirements for minimum areas and minimum widths of lots: (a) Single-Family Dwellings: Minimum area of the lot shall be four thousand eight hundred (4800) square feet and minimum width of lot shall be forty (40)
feet.
(b) Two-Family Dwelling: Minimum area of the lot shall be four thousand eight hundred (4800) square feet and minimum width of lot shall be forty (40) feet. (c) Apartments: Minimum area of the lot shall be seven thousand two hundred (7200) square feet and minimum width of lot shall
be sixty (60) feet.
d. YARDS. The Yard Regulations are identical with those prescribed herein for the R-l Single-Family Residential District, except that Apartments, whioty are constructed to heights in excess of forty (40) feet, shall provide minimum side yards oi
