sioners for final consideration: AN ORDINANCE, Granting to CENTRAL INDIANA GAS COMPANY, an Indiana corporation, the right and franchise, to use and occupy the streets, avenues, roads, bridges, alleys, lanes, parks and other public places and ways of the Village of Daleville, Salem Township, Delaware County, Indiana, for constructing, maintaining, renewing and (or) operating the gas works and (or) gas distribution system and other necessary means fOf transmitting,

BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE COUNTY OF DELAWARE, STATE OF INDIANA: Section 1. That whenever the word “Grantee” appears in this Ordinance, it is intended to designate and shall be held to mean CENTRAL INDIANA GAS COMPANY, its sucessors and assigns. SECTION 2. The right, permission and authority is hereby granted to the Grantee to lay, construct, extend, maintain, renew, replace and (or) repair gas pipes and gas mains under, along, across and (or) through any of the streets, avenues, roads, bridges, alleys, lanes, parks and other public places and (or) ways in said Village of Daleville and to use and occupy the said streets, avenues, roads, bridges, alleys, lanes, parks

and other public places and (or) ways for the purpose of therein laying, constructing, extending, maintaining, renewing, replacing and (or) repairing mains and pipes and all appurtenances and appendages thereto used and (or) useful for the manufacture, tranmission, distribution and (or) sale of gas within and (or) through the present or future territorial limits of the Village of Daleville in Salem Township, Delaware County, Indiana, such right to continue for fifty (50) years after the effective date of this Ordinance. SECTION 3. The Grantee shall be entitled to charge for gas furnished by it, such rates as are or may be legally fixed and declared to be just and reasonable by the duly constituted Governmental authority having lawful jurisdiction thereof. During such time as there shall be no other duly constituted Governmental authority lawfully exercising such jurisdiction. The
Board of Commissioners of the County of Delaware, shall have the jurisdiction and right to prescribe and fix by ordinance, maximum rates for furnishing such gas service, sufficient to yield a reasonable return upon the fair value of the property of the Grantee used and useful in rendering such service'. SECTION 4. Subject to the laws of the State of Indiana, all rights herein granted and (or) authorized, shall be subject to and governed only by this Ordinance: provided, however, that The Board of Commissioners of the County of Delaware expressly reserves unto itself all of Its police power necessary to protect the safety and welfare of the general public in relation to the rights hereby granted, not inconsistent with the provisions of this Ordinance: and provided, further, that the conditions and obligations assumed by and imposed upon said Grantee as
