Dr. Kilgore was so badly injured that he was taken to an Indianapolis hospital, where it was discovered that he had suffered a broken neck. He recovered after several weeks hospital care. The history that is slowly but surely being made has at last disclosed that the Post-Democrat knew what it was talking about when it took violent exceptions to the type of men and women chosen for jury service in the circuit
court.
The “good Christian gentleman” Jake Cavanaugh, who testified at the Dearth impeachment trial that Dearth qualified him as real estate owner by deeding him a plot of ground about big enough for a coal shed or a one car garage, and that he drew the names from a little red book, w T as fired by Dearth when public sentiment blazed. John Hampton, our fine young business mayor, who never knew Muncie was filled with blind tigers, brothels and gambling dens until Winkler’s men filled the superior court room with booze and booze sellers, was Cavanaugh’s accom plice in packing jury boxes. Between the two of them was hatched up the jury system which made the state sit up and gasp when its ex posure came in the Dearth trial.

Many states and quite a few of. the larger cities have wild life sanctuaries, which are truly cities of refuge for every wild thing that can escape into their protection. We have nothing like this in or near Portland but we can take care of the hirds, who are man’s best friend. Many of our people are doing this already, for in most of the home gardens bird houses and seed bearing shrubs will be found. While a great many birds will have gone south by the end of November, there will be many in-sect-eating birds staying with us through the winter months. Now is the time to hang suet in the trees and to put seeds on the feeding shelf. Oatmeal is a favorite of many birds and make a welcome addition to the usual seeds and grain. Be sure that some sunflower seeds are included, as these are the ones the cardinals prefer. Let the birds know that you are their friend and can he depended upon for food when the ground is covered with snow and ice.
NOTICE TO BIDDERS
(Continued from Page One) ters. Somebody must have sent 'the word down the line to “cease firing.” We do not attempt to say that this terrible story of Duffy’s of 'the proposed assassinaion of the editor, is true, hut we do know' this: That the frenzied effort of the police to impeach his word would be muclti easier to swallow' if they had evinced any interest a year ago, when the victim of the alleged murder plot named the same people in the attempts that were being made then that are now named by Duffy as being the 'instigators of the alleged Ft. Wa> A ne
plot.
The following story from Fort Wiayne corroborates, in part, the story told by Duffy to the PostDemocrat Monday: Ft. Wayne, Nov. 25.—That a Ft. Wayne youth was implicated in the alleged plot to murder George Dale editor of the Muncie Post-Demo-crat, and John, Cox of Muncie, was learned Thursday when James Rose, aged 20, 1229 1-2' South, Calhoun street, gave a statement to Frank Conroy, federal prohibition agent here. Rose declares that he met Eddie
the inspection of said bidders. Each bidder may bid on any or all classes. An affidavit of Non-Collusion and a bond for the faithful performance of said bid or contract must accompany each bid. Said bond to be made payable to the State of Indiana in a sum equal to or greater than the amount of said bid. All bids must be made on the forms provided for by the Auditor of said county. The Commissioners reserve the right to reject any and all bids. Done this 16th day of November,
1927.

Smith was fired by the county commissioners, but Harry Mott, who is right now functioning as deputy road superintendent, once admitted under oath that he had swindled Delaware county out of a large sum of money by filing false claims. Mott served bn the grand jury with Durward Sharp and helped indict^the editor of this news-
paper.
Mott’s chief, County Road Superintendent Owen Heivie, who sat on the grand jury , with Sharp and Mott, drove into Elwood 4runk late one night last August in a countyowned automobile, accompanied by

Smith, also of this city. Duffy brought the proposed plot to light Saturday in a federal court room at Indianapolis, alleging that he was offered $500 by two Muncie police department members to kill Dale and Cox. Arrested on a prostory and officials are now seeking hibition law charge, Duffy told his substantiation of it. The names of the police officers were wtihheld. Duffy was held under $5,000 bond but made no effort to obtain his re lease, saying that he preferred ar Indianapolis jail “to those vul tures’” in Muncie. Rose says that he knew Duffy for two days while the latter stopped at the Calhoun hotel here and was to drive him to Muncie, but police officers seized him on the day be fore the proposed trip. Rose was released after he had made his statement today. He declared that he did not know the Mrs. Helen Smith who was tc accompany him and Duffy to Mun ci-e, but the latter’s statement in Indianapolis charges that he did. Mrs. Smith is expected to appeal before ofljeers and also make a statement as to her part in, the alleged plot. Dale’s vice crusade at Muncie has brought him nation-wide fame and and also a 90-day jail sentence foi contempt of court. He was sentenced by Circuit Judge Clarence W. Dearth, but served one day of the term, being paroled after that time. Dearth was later tried before the Indiana legislature on Dale’s corrupt charges, and the house voted against him by an overwhelming majority, but the senate did noi concur in the impeachment. Dale took his case to the Unitec States supreme court, hut that bod} held that the truth of his charges was no defense in contempi
charges.

Supreme Court Holds State Has Right to Regulate Educational Affairs.
Washington, Nov. 25.—Race segregation of children in public schools was "sustained Monday by the supreme court. The ruling was on a case from Mississippi where an attempt was made to compel the state to permit Martha Lum, daughter of an American citizen of Chinese descent to attend the Rosedale consolidated bigh school in Bolivar county, provided exclusively for white chil-
dren.
Declaring that the right and pow sr of the state to regulate the method of providing for education of its youth at public expense is clear, Chief Justice Taft in delivering the opinion said it was withih the constitutional power of the state legislature to settle without intervention of the federal court or the feet: aral constitution whether it will re juire a Chinese citizen of the Unit ad States to send its children 1 to

Michigan City, Nov. 23.—As a result of disobeying rules, D. C. Stehenson, former klan leader and now a life inmate of the state prison here, has been denied the privilege of having visitors and of read ing newspapers. A statement to this effect was made by Deputy Warden Harry D. Claudy to Robert H. Moore, attor ney for Stephenson, when Moore attempted to interview Stephenson Monday. The deputy did not say whether Stephenson was in solitary confine-
