State of Indiana, Delaware County. In the Matter of the Petition of Harriet C. Newlee, et al., for drainage No. 684. Notice is hereby given to whom it may concern that in the cause now pending in the Delaware Superior Court of Delaware County, Indiana, wherein Harriet C. Newlee, et al,, are petitioners, No. 684 of cause in said court that the undersigned James P. Dragoo, Auditor of Delaware County, Indiana, has prepared and placed in the hands of the County Treasurer of said County for collection, an assessment sheet, showing the assessments against the various tracts of lands in said Delaware County, assessed for the construction of said

Before the prisoner was tried the purse was found m the kepnels of a fox terrier puppy
15th, 1922, for the whole or any part of certain bond issue for Fifty-one Thousand, Two Hundred sixty-six and 68-100 Dollars ($51,266.68): known as “City of Muncie Funding Bonds 1922” and will be in denominations of One Thousand Dollars each for fifty thousand dollars, and one bond for the sum of $1,266.68 with interest coupons attached, and will bear interest at the rate of five per cent. (59o) per annum, payable semi-annually; said bond shall be ftunjbered from 721 to 771 inclusive, and shall mature and be payable as follows Bonds numbered 721 to 730 inclusive, Feb. 1st. 1932. Bonds numbered 731 to 740 inclusive, Feb. 1st, 1933. Bonds numbered 741 to 750 inclusive, Feb. 1st, 1934. Bonds numbered 751 to 760 inclusive, Feb. 1st. 1935. Bonds numbered 761 to 770 inclusive, Feb. 1st, 1936. Bonds numbered 771 Feb. 1st, 1936. Said bonds and coupons shall be payable at the Delaware County National Bank, of the City of Muncie, Delaware County, Indiana, one of the regular authorized city depositories, dated February 1st, 1922. • The bids or proposals shall be opened by the City Controller, at his office on the 15th day of February, 1922, between 1he hours of 1:00 o’clock p. m. and 2:00 o'clock p. m. and the said City Controller shall thereupon award said bonds as he shall see fit, a part of any number thereof to the highest and best bidder therefor : said bonds shall be sold for cash and for no? less than par. Said City Controller shall have the right to postpone such award until a later date not beyond February 20th. J9°,2. and he shall f Iso have the right to reject any or all bids or any part thereof; and also the right to accept a part of any bid, and to award upon any bid the whole or less number of bonds covered by said bid, except only that no bonds shall be sold fcjr less than par and accrued interest; and said Controller shall further have the right in his judgment and (discretion to award said bonds a part to one bidder and a part to another bidder or bidders. Each and every bid can proposal shall be presented to the City Controller sealed and with the endorsement thereon "BIDS ON CITY OF MUNCIE FUNDING BONDS,” and shall be accompanied by a certified check upon some responsible bank in the City of Muncie, Indiana, payable to the City Treasurer, in a sum of money equal to at least 2%% of the face or par value of the bonds bid for, and if the purchaser shall fail to complete the contract for the purchase of said bonds, the proceeds thereof shall be taken and deemed as agreed and liquidated damages for hte breach of the bidder’s contract of purchase, and shall be taken and deemed as payment to the city for damages. And in case any bid or proposal shall not be accepted, and there shall be no award of bonds thereon, said certified check shall thereupon be returned to such unsuccessful bidder. If there shall be awarded the whole or any part of the bonds upon any bid or proposal, the certified check shall thereupon be delivered to the City Treasurer, and the said Treasurer shall be entitled to collect the same and hold the proceeds until the completion of the purchase and payment for the bonds awarded. Should any bidder, fail to pay for any of the bonds as per bis said bid, the City shall retain the said check, and shall have the right to collect the same,’ and the proceeds thereof when collected shall be taken and deemed as agreed and liquidated lamages for such breach of contract and as a payment thereof to the City. Delivery of said bonds shall be made at the office of said City Controller of said City of Muncie, Indiana, not later than the said 15th day of February, 1922, or at such time or times as may be agreed upon by the Controller and purchaser, and the successful bidder shall take the bonds awarded to him and pay for the same; and his refusal or omission so to do shall be a breach of contract of the bid on account of. which damages shall be retained or recovered as hereinbefore set out. Said sale is made pursuant to an ordinance funding certain indebtedness of the city of Muncie, Delaware County, Indiana, in the sum and amount of Fifty-one Thousand, Two Hundred sixty-six Dollars and sixty-eight cents, passed by the Common Council of the City of Muncie, Indiana, on the 30th, day of December

Notice is hereby given that sealed bids or proposals will be received at the office of the City Controller of the City of Muncie, Delaware County, Indiana, until 12 o’clock noon, on Friday, the 17th day of February, 1922, for the purchase of fifty thousand ($50,000.00) dollars, notes of the city of Muncie, in the denom! nations of five thousand ($5,000) dollars each, said notes to be numbered consecutively from one to ten inclusive: bach of said notes to bear interest at the rate of six per cent (6%) pel- annum. Notice is hereby given that sealed bids will be received by the city controller, of the City of Muncie, Delaware County, Indiana, until 12 o’clock, noon, on Wednesday, February 15th, 1922, for the whole or any part of a certain thirty-five thousand, four hundred ($35,400.00) dollar issue of bonds known as “Fire Department Equipment Bonds, 1922,” and will be in the denominations of one thousand dollars each for thirty-five thousand dollars, and one bond for four hundred dollars, with interest coupons attached, and will bear interest at the, rate of five per cent (5 per cent) per annum, payable semi-annually: said bonds shall be numbered consecutively from 1 to 36 inclusive, and shall mature and be payable as follows: Bonds numbered 1 to 5 inclusive, February

Said bonds and coupons shall be payable at the Delaware County National Bank of the City of Muncie, Delaware County, Indiana, one of the regular authorized city depositories!, and
dated February 1st, 1922.
The bids or proposals shall be opened by the city controller, at his office on the 15th day of February, 1922, between the hours of 12 o’clock noon, and 2 o’clock p. m. and the said city controller shall thereupon award said bonds as he shall see fit, a part or any number thereof to the highest and best bidder therefor; but said controller shall have the full right to reject any or all bids or proposals, or any part thereof; and he shall have the right to accept a part of any bid and award upon any bid the whole or less numlier of bonds covered by such bid, he being the sole judge of the sufficiency or insufficiency of any bid, or he may in his judgment award a part of said bonds to one bidder, and a part to another bidder or bidders; said bonds shall be sold for cash and for not less than par and accrued interest; each and every bid or proposal shall be accompanied by a duly certified check upon some responsible bank of the City of Muncie, Indiana, and be payable to the order of the .city treasurer, for a sum of money which shall be equal to at least 2%% of the face or par value of said bonds bid for or proposed to be purchased. In case any bid or proposal shall not be accepted and there shall be no award ot bonds thereon by the city controller, said certified check shall be returned to the said unsuccessful bidder; but if the said city controller shall award the whole or any part of the bonds upon any bid or proposal, he shall deliver the certified check accompanying the said bid, to the city treasurer, and if he shall see fit, he may present the same for payment and be entitled to collect the same and shall hold the proceeds collected thereon until the completion of the purchase and payment for the bonds so awarded. In event said check is not paid upon presentation, or in event any successful bidder shall fail to complete the purchase of said bonds so awarded and shall pay for same in the manner required, the
