Section Two- Authority and Declaration of Policy WHEREAS, the General Assembly ot the State of Indiana has granted and authoriied the Board of County Commissioners ot each of the several counties of the State of Indiana to adopt Ordinances pertaining to fire prevention and conditions which, in the determination of the Board are hazardous to human life and property from fire or ex plosion, and WHEREAS, in order to implement the legislative intent expressed in Indiana Acts 1967. "Person" means any individual, firm, partnership, association or corporation Section Four - General Provisions and Restrictions for Control ot Open Fires 1. No person shall, within the limits of Kosciusko County, Indiana, outside of the corporate limits of any incorporated city or town. set. start or attempt to set or start an open fire during any period of time within which the Board of County Commissioners shall have determined and made general notification of such determination through all general news media within said County that the said Board of Commissioners deem it necessary for public safety and welfare to prohibit open fires within any township or other area defined by said Commissioners during such period of time stated or until further notice from the said Board of Commissioners without first obtaining and having in his possession written permission of the chief of the fire department ot the township furnishing fire protection in the locale of any such open fire, or the duly authorized representative of said chief. 2. No person shall leave or permit any open fire to remain burning at any time without the attendance and supervision of at least one adult human being within Kosciusko County, Indiana, outside the corporate limits of any incorporated city or town, during a period of time and in the area fixed and determined by the Board of Commissioners of Kosciusko County under paragraph nufnber 2 above Section Five - Penalties and Enforcement 1. Any person who shall fail to obey the provisions of, or violate this Ordinance, upon conviction by the Board of Commissioners of Kosciusko County. Indiana, acting in their judicial capacity, after notice and hearing, shall be fined in any sum not exceeding One hundred dollars (100) for any such con viction. 2. The Board of Commissioners of Kosciusko County, Indiana may in addition to or as an alternate of Paragraph Num bered 1 of this section, after notice and hearing restrain and enjoin any person by its order from violating the provisions of this ordinance and such order restraining or enjoining such persons may be enforced by contempt proceedings by the Board of Commissioners of Kosciusko County, Indiana. in accordance with the Statutes and laws of the State of Indiana.
